BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES FOR NOVEMBER 2, 2020 <br />ROLL CALL <br />Chairman Allain called the meeting to order at 7:00 pm via online public meeting. <br />Present: Eric Allain, Bob Papotto, Suzie Patton, Dan Rahm, Ralph Mackey <br />Staff. Law Director Michael Gareau, Jr., Planning Director Kim Lieber, Administrative Assistant <br />Nicole Rambo -Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the Building & Zoning Board of <br />Appeals minutes of October 5, 2020, motion passed 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />20-17722; Khaled Eleayar; 5464 Columbia Road <br />Representative: Khaled Elgayar, owner <br />Proposal consists of a fence on a corner lot. Property is zoned A -One Family Residence. <br />1. A 3 foot variance to the side/rear yard setback for a fence on a corner lot; code requires 20 <br />ft., applicant provides 17 ft., Section 1135.02(D). <br />2. A 4 in. variance to the minimum separation between fences on a common property line; code <br />requires 24 in., applicant provides 20 in., Section 1369.03(D). Note: Owner does have direct <br />access to the area between the two fences. <br />The applicant is seeking variances for a fence already constructed. The fence on this corner lot is <br />constructed 17 feet from the side lot line rather than the required 20 feet, so a three foot variance <br />is requested. Since a portion of the fence abuts a neighboring fence, 24 inches of separation was <br />required under the Building Code and 20 inches was provided. Mr. Elgayar recently moved into <br />the neighborhood and would like the white vinyl fence for privacy. He talked to the neighbors <br />and they do not have any issues with the fence. He spent a lot of time and money on the fence to <br />ensure it looked nice. When applying for the permit, he spoke with staff and they asked what the <br />height and material of the fence would be. The permit did not include any instructions or <br />dimensions. He did not think the extra distance would greatly impact the size of his yard but it <br />would be difficult to move now that it has been installed. Ms. Lieber thought the encroachment <br />was minimal and asked the applicant how the area between the fences would be maintained. Mr. <br />Elgayar tried to prevent the grass from growing between the fences and is able to trim the weeds <br />with a weed wacker. Ms. Patton did not think the request was substantial and would not impact <br />neighborhood visibility. She appreciated that he talked to the neighbors too. Mr. Papotto agreed <br />and appreciated that the applicant ensured he can maintain the fence and weeds. <br />Mr. Papotto moved, seconded by Mr. Papotto, to approve the following variances for 20- <br />17722; Khaled Elgayar; 5464 Columbia Road: <br />
