PLANNING & DESIGN COMMISSION <br />CITY OF NORTH OLMSTED <br />MINUTES OF JUNE 10, 2020 <br />ROLL CALL <br />Mr. Malone called the meeting to order at 7:03 pm via online public meeting. <br />Present: Dave Anderson, Greg Malone, Darrick Matthews, Humberto Olivos <br />Absent: Julie Nader, Tom Patton, Paul Schumann <br />Staff: Planning Director Kim Lieber, Law Director Michael Gareau, Jr., Assistant Law Director <br />Bryan O'Malley, Building Commissioner Jeff Grusenmeyer, Administrative Assistant Nicole <br />Rambo -Ackerman, Fire Prevention Inspector Mark Weston <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Malone moved, seconded by Mr. Anderson, to approve the Planning & Design <br />Commission minutes of May 27, 2020, motion passed 4-0. <br />COMMUNICATIONS <br />SiEn Code Update <br />Ms. Lieber said Wendy Moeller of Compass Point Planning has been helping with the sign code <br />update for the past year. It is good practice to review codes and recent changes in sign law to <br />ensure necessary changes are incorporated. This public hearing will provide time for public input <br />and discussion before the commission votes to recommend approval to City Council. Ms. <br />Moeller specializes in updating zoning codes and more specifically in sign codes. There have <br />been multiple variance requests for commercial development projects. The goal was to provide a <br />better way to provide more signage types without permitting a larger areas of signage. The <br />process started by reviewing the definition section and staff provided background info on sign <br />variances. An advisory committee was created for initial feedback. Small and large business <br />owners, sign companies, developers, residents and community members were included in <br />stakeholder meetings. <br />The Reed v. Town of Gilbert, Arizona opinion issued in 2015 stated that communities cannot <br />regulate signs based on the message, also known as content neutrality. Few areas in the North <br />Olmsted code were based on content, most was based on the type of signs. The on -premise <br />versus off -premise distinction was eliminated. A ground sign would be permitted that the owner <br />can determine the content for. Temporary sign regulations focus on the sign type, height and <br />location. There will still be a distinction between commercial and non-commercial speech to <br />allow for political and opinion signs while limiting commercial signage. The types of signs were <br />expanded to accommodate modern businesses. Provisions for drive-through facility signs and <br />driveway signs were added. The maximum sign area per building per lot was eliminated and the <br />ground and driveway signs will be calculated separately from the building signage. The ratio of <br />one square foot to one lineal foot will still apply, but will be calculated differently. <br />Section 1163.04 ensures that drive-through businesses previously granted variances for ground <br />
