BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES FOR MAY 3, 2021 <br />ROLL CALL <br />Chairman Allain called the meeting to order at 7:01 pm via online public meeting. <br />Present: Eric Allain, Bob Papotto, Suzie Patton, Ralph Mackey <br />Absent: Dan Rahm <br />Staff. Planning Director Kim Lieber, Law Director Michael Gareau, Jr., City Engineer Pietro <br />DiFranco, Building Commissioner Jeff Grusenmeyer, Permit Coordinator Katie Seeley, <br />Administrative Assistant Nicole Rambo -Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto moved, seconded by Ms. Patton, to approve the Building & Zoning Board of <br />Appeals minutes of April 5, 2021, motion passed 4-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />21-18788; Frank & Helen Piccirillo; 27420 Lusandra Circle <br />Representatives: Frank & Helen Piccirillo, owners <br />Proposal consists of a gazebo with concrete pad. Property is zoned A -One Family Residence. <br />1. An 8.56% variance for excessive rear yard lot coverage; code permits up to 20% (1,977 sq. <br />ft. based on rear yard area of 9,885 sq. ft.), applicant shows 28.56% (2,823 sq. ft.), Section <br />1135.05(B)(2). <br />The applicant has installed a concrete pad for a new gazebo in the rear yard. While a permitted <br />use, the additional area of the accessory structure results in excessive rear yard lot coverage. <br />Code allows 20% of rear yards to be covered by accessory structures and uses; the gazebo <br />addition results in 28.56% lot coverage. Ms. Piccirillo said the gazebo has not been installed yet <br />but the concrete pad was poured. They have a pool and need shade. The evergreen trees in the <br />back yard were diseased and needed to be removed. A covered patio on the back of the house <br />was in disrepair and had to be removed. They would prefer not to replace the previous covered <br />patio because it blocked the view from the kitchen. They have concerns about moving the gazebo <br />to another location included blocking the view of the pool from the second floor, possible <br />damage to the house from snow falling off the gazebo and noise when it rains at night. It did not <br />occur to the applicants that it would be greater lot coverage than would be allowed prior to <br />pouring the concrete. Mr. Mackey said the applicants have made improvements to their property. <br />Mr. Allain thought the triangular nature of the lot added to the hardship and if it was a <br />rectangular lot there is a possibility that a variance would not be required. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance for 21- <br />18788; Frank & Helen Piccirillo; 27420 Lusandra Circle: <br />
