J <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2005 -188 <br />BY: Mayor O'Grady <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER <br />INTO A RENEWED ONE -YEAR CONTRACT WITH LK <br />HEATING & COOLING INC. TO PERFORM <br />MAINTENANCE UPON THE HEATING AND COOLING <br />EQUIPMENT AT VARIOUS CITY BUILDINGS, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Director of Public Service has recommended that the City renew <br />its maintenance contract with LK Heating & Cooling for the purpose of providing <br />maintenance services to the heating and cooling equipment at various City buildings, <br />because no other company would provide quotes for the work and LK Heating & Cooling <br />has not increased its price; and <br />WHEREAS, it is the desire of this Council, acting upon the said <br />recommendation, to authorize the Mayor to enter into a renewed one -year contract with <br />LK Heating & Cooling Inc., to provide said services; <br />NOW, THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized enter into a renewed <br />one -year agreement with LK Heating & Cooling Inc. to provide maintenance upon the <br />heating and cooling equipment in various City facilities, as set forth in the attached seven <br />contracts (marked Exhibits A through G), with only such changes to said contracts to be <br />hereinafter made as are not substantially adverse to the City and which are approved by <br />the Director of Law. The character of any such changes as not being substantially adverse <br />to the City shall be evidenced conclusively by the execution of the agreements by the <br />Mayor and the approval of the agreements by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the reason that it is necessary that this Resolution go into effect immediately because <br />the current maintenance contracts expired in October, and further provided it receives the <br />affirmative vote of two - thirds of all members of Council, it shall take effect and be in <br />force immediately upon its passage and approval by the Mayor. <br />
