Ordinance No. 2005 -179 <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, OHIO, TWO - THIRDS OFALL MEMBERS <br />CONCURRING THAT: <br />SECTION 1. Pursuant to Article XVIII, Sections 9 of the Ohio Constitution, and Article XII <br />of the Charter of the City of North Olmsted, this Council authorizes and directs that the following <br />proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City <br />of North Olmsted at a special election to be held at the usual places of voting in the City on Tuesday, <br />May 2, 2006: <br />That Article II of the Charter be amended as follows so as to provide that duties and <br />procedural requirements unilaterally imposed by State law upon municipal corporations that purport <br />to limit exercises of local self - government power shall not be binding upon or applicable to the City <br />of North Olmsted, unless expressly provided for in the City Charter or by City ordinance: <br />ARTICLE II POWERS <br />The City of North Olmsted shall have all the powers, expressed or <br />implied, now or hereafter granted to municipalities by the <br />Constitution and laws of the State of Ohio, and such further powers as <br />may now or hereafter be granted by the laws of the State of Ohio; and <br />all such powers shall be exercised in the manner prescribed by this <br />Charter or by ordinance of the Council created hereby. Duties and <br />procedural requirements unilaterally imposed by the State upon <br />municipal corporations that purport to limit exercises of local <br />self - government power shall not be binding upon or applicable to <br />the City of North Olmsted, unless expressly authorized in the <br />City Charter or by City Ordinance. <br />SECTION 2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendment to Article II of the Charter shall be effective on <br />July 1, 2006. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article II of the Charter be amended so as to provide that duties <br />and procedural requirements unilaterally imposed by the State upon <br />2 <br />
