r�> <br />Ordinance No. 2005 -178 <br />SECTION 1. Pursuant to Article XVIII, Sections 9 of the Ohio Constitution, and Article XII <br />of the Charter of the City of North Olmsted, this Council authorizes and directs that the following <br />proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City <br />of North Olmsted at a special election to be held at the usual places of voting in the City on Tuesday, <br />May 2, 2006: <br />That Article VIII, Section 6 of the Charter of the City of North Olmsted be amended as <br />follows so as to provide for the City to be permitted, in accordance with State law, to make purchases <br />without local competitive bidding during real and present emergencies and from state purchase <br />programs, where the State has already conducted a State competitive bidding process: <br />ARTICLE VIII FINANCES <br />SEC. 6. PUBLIC BIDDING. <br />The Council may authorize expenditure of funds of the City in amounts exceeding those <br />provided for from time to time by the general laws of the State of Ohio governing municipal <br />corporations without public bidding for the acquisition of real estate, for the discharge of non - <br />contractual claims against the City, for personal services, for the joint use of facilities or exercise of <br />powers with other political subdivisions, of-for the product or services of public utilities (including <br />those Municipally operated), during real and present emergencies, and for the purchase of <br />goods or services offered pursuant to State programs where the State has already conducted <br />its own competitive bidding process, but no other expenditure of more than that provided for from <br />time to time by the general laws of the State of Ohio governing municipal corporations shall be made <br />except pursuant to contract made with the lowest and best bidder after public advertising and receipt <br />of bids in the manner provided by ordinance. <br />SECTION 2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendment to Article VIII, Section 6 of the Charter shall be <br />effective on July 1, 2006. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article VIII, Section 6 of the Charter of the City of North <br />Olmsted be amended to expressly provide that the City may, in <br />accordance with State law, make purchases of goods and services <br />without local competitive bidding, during real and present <br />2 <br />
