commission whose advice and recommendation may, in the opinion of <br />the Commission, assist in fulfilling its duties herein. <br />ii. Determine the development proposal warrants the input and advice of <br />an expert planning or traffic consultant and specifically require the <br />applicant to either produce such a report, at its own costs, or to <br />otherwise recommend that the City retain such consultation services <br />by agreement with the applicant on the terms and the costs thereof; <br />provided, however, that a developer shall not be required to produce a <br />planning report or to pay for a planning consultant retained by the City <br />unless it is impracticable for the office of the Director of Planning to <br />provide such planning service to the Commission due to time <br />constraints in her office, the size or complexity of the development <br />proposal or the expert planning services determined by the <br />Commission to be warranted, or for other similar good cause <br />recommended by the Director of Planning. <br />(2) In making its determinations and proposed changes pursuant to this section, the <br />Planning Commission shall: <br />i. Review the recommendations, reports or comments issued by the <br />Director of Planning, Building Official, and any other City official, <br />department, board or commission to which the proposal was referred. <br />ii. Receive and consider complaints, comments and recommendations <br />from the public. <br />iii. Receive and consider reports or recommendations provided by the <br />applicant's experts. <br />(e) Time for Review. The Planning Commission shall, within sixty days of its first review of <br />a proposal, make its determinations and changes, if any are required, unless this period of time is <br />extended, either with the consent of the applicant, because of delay attributable to the applicant, <br />or due to application to the Board of Zoning Appeals. <br />1126.08 REFERRAL BY PLANNING COMMISSION TO COUNCIL. <br />All development plans and applications for building permits, following Planning <br />Commission's review and the making of its determinations and proposed changes as authorized <br />by this chapter, shall be forwarded to the Building, Zoning and Development (BZD) Committee <br />of Council and then to Council as a whole for final approval or rejection. The Planning <br />Commission shall, in writing, provide the BZD and Council with its determinations of significant <br />adverse impact and any changes to the proposal which address, and either eliminate or <br />ameliorate, the significant adverse impact found by the Commission. If the application is <br />approved by a majority of the members elected to Council, and if the applicant meets all other <br />applicable conditions under local and state law, the Building Official shall issue the applicant a <br />building permit. <br />1126.09 PROCEDURE FOR MINOR CHANGES. <br />(a) Definition.
