% Resolution No. 2005 -165 WHEREAS, the Planning Commission on the 0 day of 200 by formal motion, (recommended — did not recommend) thal this Ordinance, insofar as it repeals Chapter 1125 of the Zoning Code and amends various provisions of Chapter 1126 of the Zoning Code, in order to effectuate the vote of the North Olmsted electorate at the November 2005 general election upon Issue 97, be adopted; and WHEREAS, following publication of newspaper notice in conformance with the provisions of Section 14 of Article IV of the Charter of the City of North Olmsted and Section 1127.03 of the North Olmsted Zon* Code, a public hearing was held on this proposed legislation on the 19 day of , 200 !o ; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMS TED, COUNTY OF CUYAHoGA, STATE OF OHIO: SECTION 1: That Chapter 149 of the North Olmsted Administrative Code, which presently reads as set forth in Exhibit A attached to this Ordinance and which is hereby incorporated into this Ordinance as if fully rewritten herein, be and hereby is amended, and, as amended, shall read as set forth in Exhibit B attached to this Ordinance, which likewise is hereby incorporated into this ordinance as if fully rewritten herein. SECTION 2: That Chapter 1125 of the North Olmsted Zoning Code, which presently reads as set forth in Exhibit C attached to this Ordinance and which is hereby incorporated into this Ordinance as if fully rewritten herein, be and hereby is repealed. SECTION 3: That Chapter 1126 of the North Olmsted Zoning Code, which presently reads as set forth in Exhibit D attached to this Ordinance and which is hereby incorporated into this Ordinance as if fully rewritten herein, be and hereby is amended, and, as amended, shall read as set forth in Exhibit E attached to this Ordinance, which likewise is hereby incorporated into this ordinance as if fully rewritten herein SECTION 4: That the Clerk of Council be and she is hereby directed to cause notice of a Public Hearing hereon to be given pursuant to the provisions of Section 14 of Article IV of the Charter of the City of North Olmsted and Section 1127.03 of the North Olmsted Zoning Code. SECTION 5: That, in all other respects, the North Olmsted Administrative and Zoning Codes, as amended and supplemented from time to time, shall remain in full force and effect. SECTION 6: That the original sections of Chapter 149 and 1126 amended or revised herein are expressly repealed, and all other ordinances or parts of ordinances or resolutions that are inconsistent or in conflict with any of the newly amended sections of Chapter 149 and Chapter 1126 are likewise repealed to the extent of such inconsistency or conflict only. 2
