CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2005 - 158 <br />BY: Council Member Orlowski <br />AN ORDINANCE AMENDING SECTION 555.03 OF CHAPTER 555 <br />(NOISE CONTROL) OF THE GENERAL OFFENSES CODE, <br />ENTITLED "SPECIFIC PROHIBITIONS, " IN ORDER TO <br />REGULATE SNOW STORAGE OPERATIONS ON COMMERCIAL <br />PROPERTYLOCA TED NEAR RESIDENCES, ASAMENDED. <br />WHEREAS, Section 555.03 of the General Offenses Code provides for <br />prohibition of certain specific activities that create unreasonable noises in or near <br />residential properties; and <br />WHEREAS, residents living near Great Northern Mall and Plazas North and <br />South have complained of excessive noise from snow storage operations conducted on <br />such commercial properties; <br />WHEREAS, it is the desire of this Council to amend Section 555.03 so as to <br />regulate snow storage operations on commercial properties in order to ameliorate the <br />impact of noise from such operations upon residences during late night and early morning <br />hours; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMS TED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 555.03 of Chapter 555 (Noise Control) of the General <br />Offenses Code, which presently reads as follows: <br />555.03 SPECIFIC PROHIBITIONS. <br />The following acts, and the causing or permitting thereof, are declared to be in <br />violation of this chapter: <br />(a) Animals and Birds. Owning, possessing or harboring any animal <br />or bird which frequently or for continued duration, howls, barks, meows, <br />squawks, or makes other sounds which create a noise disturbance across a <br />residential real property boundary. <br />(b) Places of Public Entertainment. Operating, playing or permitting <br />the operation or playing of any radio, television, phonograph, drum, <br />musical instrument, sound amplifier or similar device which produces, <br />reproduces, or amplifies sound in any place of public <br />
