CITY OF NORTH OLMSTED ORDINANCE NO. 2005 —155 BY: Mayor O'Grady and Council Members Ryan, Orlowski and Barker AN ORDINANCE DISPENSING WITH A FORMAL RFP PROCESS AND AUTHORIZING THE MAYOR, SUBJECT TO THE APPROVAL OF THE BOARD OF CONTROL, IF NECESSARY, TO ENTER INTO A PROFESSIONAL SERVICES CONTRACT WITH THE ENGINEERING FIRM OF FLOYD BROWNE GROUP TO PREPARE A PLAN OF STUDY TO BE SUBMITTED TO THE OHIO ENVIRONMENTAL PROTECTION AGENCY (OEPA) THAT IDENTIFIES PROBLEMS ASSOCIATED WITH SANITARY SEWER BYPASSING, AND DECLARING AN EMERGENCY. WHEREAS, the Ohio Environmental Protection Agency ( "OEPA ") has, in a letter dated October 3, 2005, directed the City to submit a plan of study, no later than by January 1, 2006, identifying problems associated with sanitary sewer bypassing; and WHEREAS, the City requires the services of a consulting engineers firm to prepare such plan of study; and WHEREAS, in light of the short deadline set by the OEPA in this matter, the Administration has requested and it is the desire of this Council to dispense with the formal RFP process provided for in Sections 111.03 et seq. of the Codified Ordinances, and authorize the Mayor, subject to approval of the Board of Control if necessary, to enter into a professional services contract with the engineering firm of Floyd Browne Group; and WHEREAS, the City Charter does not require competitive bidding for such contract because it is for professional (personal) services; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF N ORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1. That the Mayor be and he is hereby authorized to enter into a contract, subject to approval of the Board of Control, if necessary, with the engineering firm of Floyd Browne Group for the purpose of preparing a plan of study identifying the problems associated with sanitary sewer bypassing in the City. Said contract shall be substantially in the form of the proposal from the Engineering Firm of Floyd Browne Group, dated October 20, 2005, marked as Exhibit "A," and attached hereto with only such changes therein as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the agreement by the Director of Law.
