CITY OF NORTH OLMSTED ORDINANCE NO. 2005 -152 BY: Council Members Barker, Ryan and Orlowski AN ORDINANCE AMENDING SECTION 351.12 OF CHAPTER 351 (PARKING GENERALLY) OF THE TRAFFIC CODE, ENTITLED "ALL -NIGHT PARKING RESTRICTED, " IN ORDER TO PROHIBIT PARKING OVERNIGHT ON TREE LAWNS AND BERMS LOCATED IMMEDIATELY ADJACENT TO STREETS WITHOUT CURBS, AS AMENDED. WHEREAS, in Section 351.12 of the Traffic Code currently prohibits the parking of vehicles on streets between the hours of 2:00 AM and 6:00 AM; and WHEREAS, it is the desire of this Council to expand the prohibition of Section 351.12 in order to similarly prohibit the overnight parking of vehicles on tree lawns and berms that are located immediately adjacent to streets without curbs; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Section 351.12 of Chapter 351 (Parking Generally) of the Traffic Code, which presently reads as follows: 351.12 ALL -NIGHT PARKING RESTRICTED. No person shall permit to stand or park any vehicle upon any street in the City between the hours of 2:00 a.m. and 6:00 a.m. The Director of Public Safety shall cause signs indicating this restriction to be posted at the City limits. BE AMENDED AND, AS AMENDED, SHALL READ AS FOLLOWS: 351.12 ALL -NIGHT PARKING RESTRICTED. No person shall permit to stand or park any vehicle upon any street in the City between the hours of 2:00 a.m. and 6:00 a.m. For purposes of this Section, "street" shall include areas of tree lawns and berms located within five (5) feet of and immediately adjacent to the roadway portion of any street without curbs.
