CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2005 -138 <br />BY: Mayor O'Grady and All of Council <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF LAW TO <br />RETAIN OUTSIDE COUNSEL TO ASSIST THE CITY INCOME TAX <br />ADMINISTRATOR IN THE MATTER OF A CERTAIN TAXPAYER'S <br />APPEALS TO THE NORTH OLMSTED BOARD OF REVIEW, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Article V, Section 2 of the Charter provides that the Director of Law, <br />with the approval of City Council, may retain the services of outside counsel, where necessary <br />and appropriate, to assist in the performance of the duties of office; and <br />WHEREAS, on the request and recommendation of the Director of Finance, who <br />serves as Income Tax Administrator for the City, the Director of Law has requested that this <br />Council approve the retention of special counsel to assist the Income Tax Administrator in the <br />matter of appeals by a certain North Olmsted taxpayer to the North Olmsted Board of Review, <br />the most recent of which were filed with the Board on or about July 27, 2005; and <br />WHEREAS, the Director of Law has reviewed and approved the Director of Finance's <br />selection of the Law Firm of Hugh Morgan and Associates, which is a Cleveland law firm <br />with expertise in the field of tax law; and <br />WHEREAS, it is accordingly the desire of this Council to approve the retention of <br />said special counsel to assist the City Income Tax Administrator in the matter of the above - <br />referenced taxpayer appeals; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Law is hereby authorized to retain the services of <br />the Law Firm of Hugh Morgan & Associates, to provide special counsel services for the City <br />Income Tax Administrator in matters related to appeals by a certain North Olmsted taxpayer <br />to the North Olmsted Board of Review, the most recent of which appeals were filed on or <br />about July 27, 2005. <br />
