reasonably determine, from time to time, whether new equipment is <br />needed in order to maintain the facility as a state of the art facility. <br />Instructor shall notify the City of any new equipment purchases and shall <br />also notify the City if any equipment listed on Schedule A is removed <br />from service and /or is replaced. Instructor shall be responsible for <br />supplying all such necessary equipment, the purchasing thereof, and <br />paying for said equipment in full. Except however, that the City and the <br />Instructor shall continue to share ownership of the spring board floor <br />exercise equipment and the City shall share the cost and responsibility for <br />its maintenance and /or replacement on an equal basis, as provided below. <br />9. Obtain approval from the City's Recreation Commission prior to making <br />changes, alterations, improvements, or additions to the second (2"a) floor <br />gym area. All such improvements or alterations are fixtures, and shall <br />remain property of the City. <br />10. Insure that all areas of the gym and the equipment are inspected and <br />certified in writing on an annual basis by qualified personnel and <br />immediately provide written notification of said inspection results to the <br />City. The Instructor shall take immediate remedial action and report to <br />11. f) bt0iftyand maintain general sports liability insurance for gymnastic <br />instruction activities with policy limits of' one million /two million and <br />which names the City of North Olmsted as "an additional Insured" party <br />and provides the City with notice of cancellation. <br />The City shall: <br />1. Make the second (2 °a) floor gym area available for Instructor's programs <br />during hours approved by the City. The City will be entirely responsible <br />for maintenance of and any improvements to the building and its facility, <br />with the exception of gymnastics equipment owned or acquired by the <br />Instructor, but including the floor exercise equipment as provided herein. <br />The City and the Instructor shall continue to maintain co- ownership of <br />the floor exercise equipment and the City shall, at the direction of and <br />under the supervision of the Instructor, perform necessary maintenance <br />on the floor exercise equipment, as needed, but not more than three (3) <br />times per year. The Instructor is required to request such maintenance, <br />in a writing, through the Recreation Commissioner, with copy to the <br />Maintenance Foreman, in advance. The City may select a date to <br />schedule such maintenance, upon evaluation of such dates and times as <br />staffing requirements permit, and in consideration of the activities <br />schedule. The Instructor is required to supply the appropriate cleaning <br />and taping materials, which expenses shall be reimbursed by the City in <br />an amount not exceeding Two Hundred ($200.00) Dollars per scheduled <br />maintenance, not more than Six Hundred ($600.00) Dollars per year. Any <br />additional or emergency maintenance above and beyond the foregoing <br />shall be performed by the Instructor and the costs shared equally by the <br />parties. <br />3 <br />
