Ordinance No. 2005 -133 <br />(D) Awnings and marquees. Any awning or marquee and its <br />accompanying structural member which extend over any street, sidewalk <br />or other portion of premises shall be maintained in good repair and shall <br />not constitute a nuisance or a safety hazard. In the event that such <br />awnings or marquees are not properly maintained in accordance with the <br />foregoing, they shall, together with their supporting members, be <br />removed forthwith. In the event that such awnings or marquees are made <br />of cloth, plastic or similar material, such cloth, plastic or similar <br />material, where exposed to public view, shall be maintained in good <br />condition and shall not show evidence of weathering, discoloration, <br />ripping, tearing or other holes. Nothing herein shall be construed to <br />authorize any encroachment on streets., sidewalks or other parts of the <br />public domain. <br />(E) Storage of industrial and commercial materials or waste <br />and motor vehicle equipment. There shall not be stored or used at a <br />location visible from the sidewalks, streets or other public areas, <br />equipment, materials, waste or motor vehicle equipment relating to <br />commercial or industrial uses unless expressly permitted under the <br />Zoning Code for such premises. The parking or storage of boats, motor <br />homes, recreational vehicles, travel trailers or truck trailers used for <br />sales or storage, between the property line at the street right of way and <br />the front of every commercial or industrial building is prohibited. All <br />such boats, motor homes, recreational vehicles, travel trailers and truck <br />trailers used for sales or storage shall be stored in the rear yard and <br />screened from view. <br />In the event that the commercial or industrial building is located <br />on a corner lot, boats, motor homes, recreational vehicles, travel trailers <br />and truck trailers used for sales or storage shall not be stored or parked <br />between the property line at the street right of way and the side of the <br />building facing the street. <br />(c) Structural Soundness and General Maintenance. The exterior of every structure <br />or accessory structure (including fences, signs and store fronts) shall be maintained in good <br />repair and all surfaces thereof shall be kept painted where necessary for purposes of <br />preservation and appearance, or surface coated with a protective coating or treated to prevent <br />rot and decay. When any fence belonging to a commercial property, and serving as a <br />boundary between commercial and residential properties, falls into a state of disrepair such as <br />would require repair or replacement of more than fifty percent (50%) of the lineal footage of <br />that portion of the fence which borders residential property, the said portion of the said fence <br />which borders residential property shall be replaced, upon order of the Building <br />Commissioner, with a board -on -board fence of the same height as the old fence, provided, <br />however, that the Building Commissioner may refer the matter to the Planning Commission <br />for its input and recommendation if, in the judgment of the Building Commissioner, a board - <br />on -board fence of the same height as the old fence would not adequately serve the City's <br />interests in buffering the adjoining residential property from the impact of the commercial <br />property; and further provided, however, that the commercial property owner may request that <br />the matter be referred to the Planning Commission for review and recommendation if he or <br />she does not believe that a board -on -board fence of the same height as the old fence is <br />necessary in order to adequately buffer adjoining residential properties from the impact of his <br />or her commercial property. Upon its review of the matter when requested, the Planning <br />Commission shall determine the type and height of the new fence to be constructed along the <br />boundary between the commercial property and adjoining residential properties by applying <br />the impact standards set forth in Chapter 1126 of the Zoning Code.
