Ordinance No. 2005 -119 <br />SECTION 1. Pursuant to Article XVIII, Sections 9 of the Ohio Constitution, and Article XII <br />of the Charter of the City of North Olmsted, this Council authorizes and directs that the following <br />proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City <br />of North Olmsted at a special election to be held at the usual places of voting in the City on Tuesday, <br />November 8, 2005: <br />That Article VIII, Section 6 of the Charter of the City of North Olmsted be amended as <br />follows so as to provide for the City to be permitted, without competitive bidding, to make purchases <br />of goods and services during emergency situations and pursuant to State - offered programs: <br />ARTICLE VIII FINANCES <br />SEC. 6. PUBLIC BIDDING. <br />The Council may authorize expenditure of funds of the City in amounts exceeding those <br />provided for from time to time by the general laws of the State of Ohio governing municipal <br />corporations without public bidding for the acquisition of real estate, for the discharge of non - <br />contractual claims against the City, for personal services, for the joint use of facilities or exercise of <br />powers with other political subdivisions, ef-for the product or services of public utilities (including <br />those Municipally operated), during emergency situations, and for goods and services pursuant <br />to State - offered programs, but no other expenditure of more than that provided for from time to <br />time by the general laws of the State of Ohio governing municipal corporations shall be made except <br />pursuant to contract made with the lowest and best bidder after public advertising and receipt ofbids <br />in the manner provided by ordinance. <br />SECTION2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendment to Article VIII, Section 6 of the Charter shall be <br />effective on January 1, 2006. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article VIII, Section 6 of the Charter of the City of North <br />Olmsted be amended to expressly provide that the City may expend <br />funds, without competitive bidding, during emergency situations and <br />when purchasing goods or services pursuant to State - offered <br />programs? <br />2 <br />
