CITY OF NORTH OLMSTED ORDINANCE NO. 2005- 118 BY: Council Members Miller and Barker AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF THE CITY OF NORTH OLMSTED OFAN AMENDMENT TO ARTICLE VII, SECTION 2 OF THE CHARTER OF THE CITY OF NORTH OLMSTED TO CHANGE THE NAME AND COMPOSITION OF THE CITY PLANNING COMMISSION, TO FURTHER TO CHANGE AND EXPAND THE AUTHORITY OF THE PLANNING COMMISSION, AND TO FURTHER TO CHANGE THE MASTER PLAN REVIEW AND APPROVAL PROCESS, AND DECLARING AN EMERGENCY, AS AMENDED. WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a proposal to amend Article VII, Section 2 of the Charter of the City of North Olmsted to change the name of the Planning Commission to the "Planning and Design Commission; to change the composition of the Commission so as to include thereon a member of Council or Council appointee, a registered architect and a landscape architect; to change and expand the powers of the Planning and Design Commission, including authorizing such Commission to recommend legislation relating to municipal planning, land use and zoning classifications; and to change the Master Plan review and approval process to provide for more comprehensive plans that shall be reviewed and revised as necessary every ten (10) years; and WHEREAS, this proposal was made by the Director of Planning and was approved by the Charter Review Commission, and submitted to this Council for its consideration, in accordance with the provisions of Article XIV, Section (b)(1) of the City Charter on the 21' day of June, 2005; and WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner than 120 days, and no later than 60 days, prior to the date of the election at which the issue will be voted upon by the electorate; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, OHIO, TWO- THIRDS OFALL MEMBERS CONCURRING THAT SECTION 1. Pursuant to Article XV111, Sections 9 of the Ohio Constitution, and Article XII of the Charter of the City of North Olmsted, this Council authorizes and directs that the following proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City of North Olmsted at a special election to be held at the usual places of voting in the City on Tuesday, November 8, 2005: That Article VII, Section 2 of the Charter be amended as follows to change the name of the -- ,.�mwrw c- ��tmn,•, ,.KeHCm+� �!a«.zra ... ,...: , a� ..,. t r: xM»,gaatt, ,�..r�. ..,: ..
