(2) newspapers of general circulation three (3) separate times prior to the election, the first notice <br />shall appear not less than five (5) weeks prior to said election, and the last at least ten (10) days <br />prior to said election. Approval by a majority of the electors voting thereon is mandatory for the <br />zoning or rezoning to pass. <br />SECTION 2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendment to Article VIII, Section 2 of the Charter shall be <br />effective on January 1, 2006. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article VII, Section 2 of the Charter be amended to change the <br />name of the Planning Commission to the "Planning and Design <br />Commission; to change the composition of the said Commission so as <br />to include thereon a member of Council, or Council appointee, a <br />registered architect and a landscape architect; to change and expand <br />the powers of the Planning and Design Commission, including <br />authorizing such Commission to recommend legislation relating to <br />municipal planning, land use and zoning classifications; and to change <br />the Master Plan review and approval process to provide for more <br />comprehensive plans that shall be reviewed and revised as necessary <br />every ten (10) years? <br />E]Yes <br />11 No <br />SECTION 4. The Clerk of Council is authorized and directed to deliver a certified copy of <br />this Ordinance to the Board of Elections of Cuyahoga County no sooner than July 11, 2005, and no <br />later than September 9, 2005. <br />SECTION 5. This Council requests that the Board of Elections of Cuyahoga County cause to <br />be duly given an appropriate notice of the election to be held on November 8, 2005, on the foregoing <br />amendments to the Charter of this City and otherwise provide for such election in the manner <br />provided by the general laws of the State of Ohio. <br />0 <br />
