Ordinance No. 2005 -115 <br />Auditors or Treasurers by the laws of the State of Ohio unless otherwise provided by this Charter, <br />or by ordinance of the Council, and he shall perform such other duties as the Mayor may impose <br />upon him consistent with his office. <br />SECTION 2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendments to Article III, Section 4(d), Article IV, <br />Sections 3 and 5, and Article V, Sections 2 and3, of the Charter shall be effective on January 1, <br />2006. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article III, Section 4(d), Article N, Sections 3 and 5, and <br />Article V, Sections 2 and 3, of the Charter be amended to allow for <br />the filling of vacancies by election to the unexpired terms of the <br />various elected City offices when the vacancy occurs not less than 30 <br />days prior to the candidate filing deadline for the next regular <br />municipal election and the unexpired term has at least two years <br />remaining. <br />Elyes <br />SECTION 4. The Clerk of Council is authorized and directed to deliver a certified copy of <br />this Ordinance to the Board of Elections of Cuyahoga County no sooner than July 11, 2005, and no <br />later than September 9, 2005. <br />SECTION S. This Council requests that the Board of Elections of Cuyahoga County cause <br />to be duly given an appropriate notice of the election to be held on November 8, 2005, on the <br />foregoing amendments to the Charter of this City and otherwise provide for such election in the <br />manner provided by the general laws of the State of Ohio. <br />SECTION 6.
