Ordinance No. 2005 -114 <br />SECTION 1. Pursuant to Article XVIII, Sections 9 of the Ohio Constitution, and Article X11 <br />of the Charter of the City of North Olmsted, this Council authorizes and directs that the following <br />proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City <br />of North Olmsted at a special election to be held at the usual places of voting in the City on Tuesday, <br />November 8, 2005: <br />That Article II of the Charter be amended as follows so as to provide that duties and <br />procedural requirements generally imposed by State law upon municipal corporations, to the extent <br />that Home Rule authority permits, shall not be binding upon or applicable to the City of North <br />Olmsted, unless expressly provided for in the City Charter or by City ordinance: <br />ARTICLE II POWERS <br />The City of North Olmsted shall have all the powers, expressed or implied, now or hereafter granted <br />to municipalities by the Constitution and laws of the State of Ohio, and such further powers as may <br />now or hereafter be granted by the laws of the State of Ohio; and all such powers shall be exercised <br />in the manner prescribed by this Charter or by ordinance of the Council created hereby. No State <br />statute or regulation that purports to impose duties upon or establish procedures for a <br />municipal corporation in the exercise of any of its home rule or local self - government powers <br />shall have application in or be binding upon the City of North Olmsted unless expressly <br />provided for in this Charter or by ordinance of the City Council. <br />SECTION2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendment to Article II of the Charter shall be effective on <br />January 1, 2006. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article II of the Charter be amended so as to provide that duties <br />and procedural requirements generally imposed by State law upon <br />municipal corporations, to the extent that Home Rule authority <br />permits, shall not be binding upon or applicable to the City of North <br />Olmsted, unless expressly provided for in the City Charter or by City <br />ordinance <br />W <br />
