The Director of Law shall be a non - voting member and shall serve the Board of Control only as legal counsel. The Mayor shall be ex officio president and shall appoint a secretary. The Board shall keep a journal of its proceedings. The voting shall be taken by "yeas" and "nays" and entered in the journal and the vote of the majority of all of the voting members of the Board shall be necessary to adopt any question, motion, or order. No contract involving expenditures in excess of that amount specified in Section 6 of Article VIII of this Charter shall be entered into without the prior approval of the Board of Control. The Board shall have such further powers and perform such further duties as shall be prescribed by ordinance. SECTION 2. If the foregoing proposal receives the affirmative vote of a majority of the electors voting thereon, then the said amendment to Article VII, Section 5 of the Charter shall be effective on January 1, 2006. SECTION 3. It is the desire of the Council that the ballot for said question shall be in substantially the following form: PROPOSED CHARTER AMENDMENT A majority affirmative vote is necessary for passage. Shall Article VII, Section 5 of the Charter of the City of North Olmsted be amended so as to provide that the Director of Law shall be a non - voting member of the Board of Control and serve the Board of Control only as legal counsel? Yes No SECTION 4. The Clerk of Council is authorized and directed to deliver a certified copy of this Ordinance to the Board of Elections of Cuyahoga County no sooner than July 11, 2005, and no later than September 9, 2005. SECTION S This Council requests that the Board of Elections of Cuyahoga County cause to be duly given an appropriate notice of the election to be held on November 8, 2005, on the foregoing amendments to the Charter of this City and otherwise provide for such election in the manner provided by the general laws of the State of Ohio. 2
