Ordinance No. 2005 -111 <br />That Article X, Section 4 of the Charter of the City of North Olmsted be amended as follows <br />so as to provide for recall elections in North Olmsted to be conducted in accordance with State law <br />recall procedure: <br />ARTICLE X INITIATIVE, REFERENDUM AND RECALL <br />SEC. 4. GENERAL PROVISIONS <br />The manner of signing, the method of circulating, the form and requirements as to the affidavit, and <br />the other requirements of the general law regulating initiative and referendum and recall petitions, <br />shall apply in the case in of initiative, referendum and recall in this municipality, except as otherwise <br />provided in this Charter. <br />SECTION 2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendment to Article X., Section 4 of the Charter shall be <br />effective on January 1, 2006. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article X, Section 4 of the Charter of the City of North Olmsted <br />be amended so as to provide that the procedure for initiating a recall <br />of any elected city official, unless otherwise provided for in the <br />Charter, shall be conducted in accordance with State law governing <br />recall rather than State law governing initiative and referendum? <br />Yes <br />No <br />SECTION 4. The Clerk of Council is authorized and directed to deliver a certified copy of <br />this Ordinance to the Board of Elections of Cuyahoga County no sooner than July 11, 2005, and no <br />later than September 9, 2005. <br />SECTION S.
