k Ordinance No. 2005 -109 <br />SECTION 1. That the Mayor is hereby authorized to enter into a personal <br />service contract not to exceed the amount of Ten Thousand ($10,000) Dollars with <br />Leinweber Engineering, Ltd. as structural consultants to analyze the condition of the <br />Recreation Center pool roof and to prepare specifications for its repair. This is proposed <br />as an exception to RFP since preliminary analysis has been invested already and bringing <br />in a second source will require the expense of a new firm to repeat the same analysis. <br />Said agreement shall be in a form deemed sufficient by the Director of Law and <br />containing such terms and conditions that are necessary for and consistent with this <br />Ordinance. Such terms and conditions therein are not substantially adverse to the City <br />and which are approved by the Director of Law. The character of any such terms and <br />conditions as not being substantially adverse to the City shall be evidenced conclusively <br />by the execution of the agreement by the Mayor and the approval of the agreement by the <br />Director of Law. <br />SECTION 2. That this Council declares that sufficient funds have been <br />appropriated for the expenditures relating to the subject professional services agreement <br />and hereby approves payments to Leinweber Engineering Ltd. that are consistent with the <br />provisions of the subject agreement in an amount not to exceed Ten Thousand ($10,000) <br />Dollars. <br />SECTION 3. That this Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and <br />welfare, and for the further reason that it is necessary that this legislation be effective <br />immediately so that the City can prepare specifications for and commence construction <br />during the planned shut down of the indoor pool and so that the improved indoor pool <br />facility is ready for this winter's programs; and further provided it receives the <br />affirmative vote of two- thirds of all members of Council, it shall take effect and be in <br />force immediately upon its passage and approval by the Mayor. <br />PASSED: .c d Do S� First Reading: D J <br />Second Reading: z eL� •� <br />Third Reading :`� <br />Committee: e ", <br />AT ST <br />r BARBARA L.
