CITY OF NORTH OLMSTED RESOLUTION NO. 2005 -103 BY: Mayor O'Grady A RESOL UTION A UTHORIZING THE MAYOR TO ENTER INTO A CONTRACT FOR THE PURCHASE OF REAL PROPERTY LOCATED AT 29590 LORAIN ROAD, NORTH OLMSTED, OHIO, TO BE USED AS THE SITE FOR THE NEW FIRE STATIONAPPROVED BY THE VOTERS OF NORTH OLMSTED. WHEREAS, the voters of the City of North Olmsted on November 2, 2004 passed a bond issue for the purpose of acquiring property and constructing a new Fire Station, and purchasing related equipment; and WHEREAS, the Director of Law, pursuant to the direction of the Mayor and this Council, has entered into negotiations with the owners of the real property at 29590 Lorain Road for purposes of purchasing said property to be used as the site for new Fire Station; and WHEREAS, the Director of Law has reached tentative agreement with the owners of said real property, subject to final approval by this Council; and WHEREAS, it is the desire of this Council to authorize the Mayor to purchase the said real property in accordance with the terms negotiated by the Director of Law, and to execute a purchase agreement and all other documents necessary to effectuate the purchase of said property; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized to enter into contract with the owners of the real property located at 29590 Lorain Road, North Olmsted, Ohio, to purchase said property for use as the site of the new Fire Station approved by the voters of North Olmsted at the November 2, 2004 election. The Mayor is further authorized to execute any and all such additional documents required to effectuate said purchase. Said contract shall be substantially in the form of the Purchase Agreement that is attached hereto and marked as Exhibit "A with only such changes therein as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the agreement by the Director of Law.
