property as lessees, tenants at sufferance, or trespassers; <br />(3) To the best of Seller's knowledge, Seller has complied with all applicable laws, <br />ordinances, regulations, statutes, rules, and restrictions relating to said property, or any part <br />thereof, <br />ARTICLE 4. BREACH <br />By Seller <br />4.01 Should Seller default on the full and timely performance of any obligation under <br />the terms of this Agreement for any reason other than Buyer's default, Buyer may: <br />(1) Enforce specific performance of this Agreement; or <br />(2) Request that all funds paid by Buyer be forthwith returned to Buyer, and /or bring <br />suit for damages against the Seller. <br />By Buyer <br />4.02 Should Buyer fail to consummate the purchase of said property, the conditions to <br />Buyer's obligations as set forth above in this Agreement having been satisfied and Buyer being <br />in default, and Seller not being in default hereunder, Seller may: <br />(1) Bring suit for damages against Buyer; or <br />(2) Rescind the transaction. <br />ARTICLE 5. MISCELLANEOUS <br />Buyer to Purchase Property "As Is" <br />5.01 Except as otherwise specified herein, Buyer acknowledges that said property is <br />being purchased for purposes of the construction of a new fire station. All structures will be razed <br />or moved from the .property. Consequently, the City waives any disclosure requirements relating <br />to the conditions of the buildings upon the said property and agrees to take the property in an "as <br />W, <br />
