CITY OF NORTH OLMSTED ORDINANCE NO. 2005 - 95 BY: Mayor O'Grady AN ORDINANCE AMENDING VARIOUS SECTIONS OF CHAPTER 1138 (SENIOR RESIDENCE DISTRICT) OF THE NORTH OLMSTED ZONING CODE IN ORDER TO CLARIFY AND UPDATE DEVELOPMENT REGULATIONS FOR THE SENIOR RESIDENCE DISTRICT AS AMENDED. WHEREAS, the Director of Planning has recommended that various sections of Chapter 1138 of the City Zoning Code be amended in order to clarify and update development regulations for the Senior Residence District; and WHEREAS, the features of the updated regulations would include: (1) permitting more flexibility within guidelines established by the State Department of Health; (2) clarifying development, landscape, signage and parking regulations, (3) bringing review procedures in line with newly revised Chapter 1126 of the Zoning Code; and WHEREAS, it is the desire of this Council to appropriately amend various sections of Chapter 1138 consistent with the Planning Director's recommendations; and WHEREAS, the Planning Commission on the A day of , 2005, by formal motion, (recommended — did not recommend) that tids Ordinance amending various sections of Chapter 1138 in order to clarify and update development regulations for the Senior Residence District, be adopted; and WHEREAS, following publication of newspaper notice in conformance with the provisions of Section 14 of Article IV of the Charter of the City of North Olmsted and Section 1127.03 of the North Qlmsted Zon' g Code, a public hearing was held on this proposed legislation on the U day of 4 c� , 2005; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: SECTION 1: That Chapter 1138 of the North Olmsted Zoning Code, which presently reads as set forth in Exhibit A attached to this Ordinance and which is hereby incorporated into this Ordinance as if fully rewritten herein, be and hereby is amended, and, as amended, shall read as set forth in Exhibit B attached to this Ordinance, which likewise is hereby incorporated into this ordinance as if fully rewritten herein.
