CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2005 — 77 <br />BY: Mayor O'Grady <br />A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF <br />NORTH OLMSTED TO ENTER INTO A RENEWED FEDERAL <br />EQUITABLE SHARING AGREEMENT WITH THE UNITED STATES <br />OF AMERCA DEPARTMENTS OF JUSTICE AND TREASURY, FOR <br />THE PERIOD OCTOBER 1, 2005, THROUGH SEPTEMBER 30, 2008, <br />IN ORDER TO CONTINUE THE CITY'S PARTICIPATION IN THE <br />EQUITABLE SHARING PROGRAM, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the City of North Olmsted currently participates in the federal government's <br />Equitable Sharing program, which provides for local law enforcement agencies to share in and <br />receive a portion of federally forfeited cash, property, proceeds, and interest thereon; and <br />WHEREAS, the City's current agreement expires on September 30, 2005; and <br />WHEREAS, the Chief of Police requests that this Council authorize the Mayor to execute <br />a renewal agreement with the federal government for the period October 1, 2005, through <br />September 30, 2008, because the equitable sharing program confers a clear financial benefit to <br />the City of North Olmsted; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to enter <br />into the said renewed agreement with the United States of America Departments of Justice and <br />Treasury; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into a renewed <br />federal Equitable Sharing Agreement with the United States of America Departments of Justice <br />and Treasury, for the period October 1, 2005, through September 30, 2008, in order to continue <br />the City's participation in the said federal equitable sharing program, which renewed Agreement <br />shall be in the form and substance of the attached 2 -page Federal Equitable Sharing Agreement, <br />marked as Exhibit A and attached hereto, with only such changes to be hereinafter made as are <br />not substantially adverse to the City and which are approved by the Director of Law. The <br />character of any such changes as not being substantially adverse to the City shall be evidenced <br />conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement <br />by the Director of Law. <br />
