CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2005 - 73 <br />By: Mayor O'Grady <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE <br />TO PURCHASE ONE FRONT END LOADER THROUGH THE STATE <br />PURCHASE PROGRAM, FURTHER AUTHORIZING THE MAYOR TO <br />EXECUTE A PURCHASE AGREEMENT WITH WEST SHORE NEW <br />HOLLAND, INC., AND DECLARING AN EMERGENCY. <br />WHEREAS, the North Olmsted Service Department needs to purchase a new Front End <br />Loader; and <br />WHEREAS, the funds necessary for the purchase of this vehicle have appropriated by <br />this Council are available for this purpose; and <br />WHEREAS, the contract for the purchase of the said vehicle is not legally required by the <br />City Charter to be competitively bid locally, because it is being purchased through the State <br />Purchase Program, which is a State - approved competitive bidding program; and <br />WHEREAS, it is the desire of this Council to authorize the Director of Public Service to <br />purchase a new front end load from West Shore New Holland, Inc., through the State purchase <br />program, as the lowest and best bidder, and to further authorize the Mayor, following approval of <br />the Board of Control, if necessary, to execute a written purchase agreement; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he is hereby authorized to <br />purchase through the State Purchasing Program, which was established by O.R.C. Section 125.04 <br />and which the City is authorized to participate in pursuant to Ordinance No. 87 -6, one new front <br />end loader from West Shore New Holland, Inc; and further, that as necessary to effectuate any <br />such purchase through the State Purchasing Program, the Mayor is hereby authorized to execute <br />any contract and/or other appropriate documents required by the authorized vendor or the State of <br />Ohio. Any such contract(s) executed by the Mayor shall be in a form and substance consistent <br />with the provisions of this Resolution and approved by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately to insure <br />availability of this vehicle necessary to conducting vital Service Department activities during the <br />order period, and further provided it receives the affirmative vote of two - thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />
