Resolution No. 2005 -64 <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor and Council of the City of North Olmsted hereby urge the <br />Ohio Department of Transportation ( "ODOT ") to take immediate action to reconsider its <br />decision to eliminate the portion of State Route 252 ( "SR 252 ") from Country Club Boulevard to <br />Al Moen Drive, in the City of North Olmsted, including the approaches to and the bridge over <br />Interstate 480, from the 2005 Urban Paving Program, and, upon reconsideration, to return <br />repaving of this section of State Route 252 to the Program in order to address a pressing highway <br />need, that includes badly deteriorating approaches to a bridge over Interstate 480, that cannot be <br />timely attended to in any other practicable manner by the City of North Olmsted; and that ODOT <br />assume and pay the additional costs of the needed repairs to State Route 252 (SR 252), including <br />the approaches to and the bridge over Interstate 480. <br />SECTION 2: That the Clerk of Council be, and hereby is, directed to forward a fully <br />attested copy of this Resolution upon passage and approval to Governor Bob Taft; Gordon <br />Proctor, Director of the Ohio Department of Transportation; Howard R. Maier; Executive <br />Director, Northeast Ohio Areawide Coordinating Agency ( "NOACA "); Congressman Dennis <br />Kucinich; State Senator Robert Spada; and State Representative Sally Conway Kilbane. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary for this Ordinance to go into effect immediately so it may be <br />timely received by State, federal and regional officials before the specifications for the 2005 <br />ODOT Urban Paving Program are finalized, and further provided that it receives the affirmative <br />vote of two- thirds of all members of Council, it shall take effect and be in force upon its passage <br />and approval by the Mayor. <br />'1 <br />PASSED: <br />ATTTEST: <br />j BA BARA L.
