CITY OF NORTH OLMSTED ORDINANCE NO. 2005 - 63 BY: Council Members Gareau and Nashar AN ORDINANCE CREATING NEW SECTION 1334.10 OF THE BUILDING CODE, ENTITLED "LANDMARKS, FEE, DEPOSIT AND EXPENSES REIMBURSEMENT WAIVER, "IN ORDER TO AUTHORIZE THE WAIVER OF FEE, DEPOSIT AND EXPENSES REIMBURSEMENT REQUIREMENTS OF CHAPTER 1334 FOR NON - PROFIT ORGANIZATIONS MOVING NORTH OLMSTED LANDMARKS WITHIN OR OUT OF THE CITY OF NORTH OLMSTED. WHEREAS, Chapter 1334 of the Building Code regulates the moving of buildings and other structures within, through, into or out of the City of North Olmsted; and WHEREAS, said Chapter 1334 contains provisions requiring that persons moving buildings and other structures must first obtain a permit from the City Building Commissioner and, among other things, must also pay a permit fee and provide the City with a deposit in twice the amount of the estimated expenses the City will incur in providing certain governmental services during the course of the moving of the said building or other structure within, through, into or out of the City; and WHEREAS, this Council believes that preserving City Landmarks is an important City goal; and WHEREAS, this Council further believes that waiving City fee, deposit and expenses reimbursement requirements in the moving of City Landmarks within or out of the City will encourage and promote the preservation of such Landmarks; and WHEREAS, Council accordingly desires to create a new Section 13 34. 10 in Chapter 1334 of the Building Code that will authorize the waiver of fee, deposit and expenses reimbursement requirements of Chapter 1334 for the moving of North Olmsted Landmarks by non - profit organizations where necessary in order to preserve the Landmark; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That there be and hereby is created new Section 1334.10 of Chapter 1334 (Moving Buildings) of the Building Code, which as created shall read as follows: . 14 .1.11 x_ ,.,, ., ,10—W T, . , ,........r..
