CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2005 - 54 <br />BY. Council Member Gareau <br />AN ORDINANCE AMENDING SECTION 13 1. 01 OF THE <br />ADMINISTRATIVE CODE, ENTITLED "MAYOR'S <br />CONTRACT AUTHORITY" IN ORDER TO INCREASE THE <br />MA YOR'S LIMITED AUTHORITY TO EXECUTE <br />CONTRACTS INVOL VING EXPENDITURES FROM TWO <br />THOUSAND DOLLARS OR LESS TO FIVE THOUSAND <br />DOLLARS OR LESS. <br />WHEREAS, Article III, Section 5 of the City Charter provides that the Mayor shall <br />execute all contracts to the City is a party; and <br />WHEREAS, Article IV, Section 13 of the City Charter provides the City Council with <br />general authority to establish City contracting procedure, consistent with other provisions of the <br />Charter; and <br />WHEREAS, it is the desire of this Council to amend Section 131.01 of the <br />Administrative Code, which currently authorizes the Mayor to execute contracts to which the <br />City is a party involving expenditures of Two Thousand Dollars or less, subject to the <br />determination of the Director of Finance that funds have been appropriated and are available for <br />such contract expenditure, and further subject to the opinion of the Director of Law that the <br />contract is in proper form and substance, so as to increase said mayoral authorization to Five <br />Thousand Dollars; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 131.01 of the Administrative Code entitled, "Mayor's <br />Contract Authority," which presently reads as follows: <br />"131.01 MAYOR'S CONTRACT AUTHORITY. <br />(A) The Mayor may execute any contract to which the City is a party without obtaining <br />authorization of Council if all of the following conditions exist: <br />(1) The contract does not involve an expenditure of City funds in excess of Two <br />Thousand Dollars; <br />(2) The Director of Finance certifies, if an expenditure of funds is involved, that, <br />pursuant to R.C. Section 5705.41, sufficient funds have been lawfully appropriated and <br />are available for such expenditure; and <br />(3) The Mayor requests and obtains a written opinion from the Director of Law <br />that the contract is in proper form and substance." <br />
