Resolution No. 2005 -40 <br />WHEREAS, the Director of Transportation has approved said PID No. 75516 and <br />has presented the attached documentation entitled "Final Resolution, Fiscal Officer's <br />Certificate, Contract and Escrow Agreement for Highway Improvement" for final <br />legislative approval of the cooperative arrangement with ODOT, based on plans and <br />specifications for improving the above described highway, and has presented the attached <br />copies to this Council for authorization to proceed; and <br />WHEREAS, the Director of Transportation has approved said PID No. 75516 and <br />has estimated the City's share of the project costs in the amount of Eighty Nine Thousand <br />Eighty Two and 00 /100 Dollars ($89,082.00), based on plans and specifications for <br />improving the above described highway, and as presented in the attached copies, subject <br />to the approval and appropriation of this Council to proceed; and <br />WHEREAS, it is the desire of this Council, as the LPA, to enable the Director of <br />Transportation to proceed with the aforesaid highway improvement and therefore desires <br />to authorize the Mayor to execute, on behalf of the City, all Contract, Escrow or other <br />related documents; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMS TED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the LPA hereby requests the Director of Transportation to <br />proceed with the aforesaid highway improvement. Accordingly, this Council does <br />hereby, as LPA, fully adopt and enact the "Final Resolution" a copy of which is attached <br />as Exhibit 1, as if fully rewritten herein. <br />SECTION 2: That the estimated sum of Eighty Nine Thousand Eighty Two and <br />00 /100 Dollars ($89,082.00) is hereby appropriated for the improvement described above <br />and the Director of Finance is hereby authorized and directed to pay said sum, upon the <br />appropriate requisition of the Director of Transportation and at such time as required by <br />law to pay the cost and expense of said improvement; and that the City hereby agrees to <br />assume in the first instance the share of the cost and expense over and above the amount <br />to be paid from State funds. Further, that the Director of Finance be and she is hereby <br />authorized to execute, on behalf of the City, as LPA, the "Fiscal Officer's Certificate" a <br />copy of which is attached as Exhibit 2. <br />SECTION 3: That the City, as LPA, shall enter into a Contract and an Escrow <br />Agreement for Highway Improvement with the State of Ohio, copies of which are <br />attached hereto as Exhibits 3 and 4 respectively; and that the Mayor be, and he hereby is, <br />authorized to execute said Contract and Escrow Agreement, providing for the payment by <br />the LPA of the sum of money set forth herein above for improving the described project. <br />SECTION 4: That the Clerk of Council, on behalf of the City as LPA, upon <br />passage, transmit to the Director of Transportation a fully executed copy of this <br />Resolution. <br />
