Ordinance No. 2005 -25 <br />Page 2 <br />SECTION 1: That the Building Commissioner be and he is hereby authorized to <br />proceed with, arrange for, and initiate all reasonable measures, either directly or through <br />his designee, to demolish and remove all dangerous buildings located at 4170 Columbia <br />Road, City of North Olmsted, inasmuch as demolition has been Ordered and declared <br />necessary by the Board of Building Code Appeals to abate said public nuisance pursuant <br />to Chapter 1331 of the Codified Ordinances, and based on the further determination of <br />this Council that it is necessary for the City of North Olmsted to cause such demolition to <br />proceed pursuant NOCO § 1331.05(e) to protect the health, safety and general welfare of <br />the citizens and, finally, due to the failure of the property owner, lienholders or other <br />persons having an interest in the property to comply with multiple demolitions Orders for <br />more than 60 days. <br />SECTION 2: That the Mayor be and he is hereby authorized to enter an <br />agreement with or contract for the service of a demolition contractor, if necessary or as <br />reasonable to secure the services of such a demolition contractor recommended by the <br />Building Commissioner, to provide for and proceed with the razing of all dangerous <br />buildings located at 4170 Columbia Road, City of North Olmsted, which contract shall be <br />in a legal form and contain substance deemed necessary by the Director of Law. The <br />character of any such contract as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the Agreement by the Mayor and the <br />approval of the Agreement by the Director of Law. <br />SECTION 3: That the Clerk of Council be and she is hereby directed, with the <br />assistance and direction of the Director of Finance and the Director of Law, to certify the <br />entire cost of demolition, including the cost of service, all interest and penalties allowed <br />by law, together with a proper legal description of the premises at 4170 Columbia Road, <br />to the office of the Cuyahoga County Auditor, which shall thereby constitute a tax lien <br />vested and granted priority pursuant to Ohio Revised Code §§ 715.26 and 715.261. <br />SECTION 4: That the Clerk of Council be and she is hereby directed to forward <br />a copy of this Ordinance by certified mail to the property owner, lienholders and all other <br />persons having an interest in the property, as the names and addresses appear in the <br />records of the Building Commissioner and the Board of Building Code Appeals. <br />SECTION 5: That this Council declares that sufficient funds have been <br />appropriated for the expenditures relating to the subject demolition and removal service <br />contract and hereby approves payments to be made by the Director of Finance that are <br />consistent with the provisions of this Ordinance. <br />SECTION 6. That this Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and <br />welfare, and for the further reason that it is necessary that this legislation be effective <br />immediately so that the public nuisance can abated by the City expeditiously, and further <br />provided it receives the affirmative vote of two- thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />
