Ordinance No. 2005 -23 <br />WHEREAS, the City disputes said claim presented by AFSCME on behalf of the <br />City's transit employees, but in order to obtain the benefit of finality in the matter and to <br />promote good labor- management relations in the City, the City is willing to compromise <br />the said claims in exchange for receiving a full and complete release from AFSCME; and <br />WHEREAS, based upon the recommendations of the City's negotiating team, it is <br />the desire of this Council to authorize the Mayor to enter into an Agreement with <br />AFSCME and GCRTA providing for such a compromise of said employee claims in <br />exchange for the City and GCRTA obtaining a full and complete release from AFSCME <br />in such matter; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized, on behalf of the <br />City of North Olmsted, to enter into and execute an Agreement with the American <br />Federation of State, County and Municipal Employees, Ohio Council 8 and Local 3517 <br />( "AFSCME ") and the Greater Cleveland Regional Transit Authority ( "GCRTA "), <br />providing for the payment of compensation to certain North Olmsted transit employees <br />and the receipt, in exchange for said payment, of a full and comprehensive release from <br />AFSCME, acting on behalf of all North Olmsted transit employees. The Agreement shall <br />be in form and substance substantially similar to the "Employee Transition Agreement, " <br />attached to this legislation as Exhibit A, with only such changes to be hereinafter made as <br />are not substantially adverse to the City of North Olmsted and which are approved by the <br />Director of Law. The character of any such changes as not being substantially adverse to <br />the City shall be evidenced conclusively by the execution of the Agreement by the Mayor <br />and the approval of the Agreement by the Director of Law. <br />SECTION 2: That the Mayor is further hereby authorized to execute, deliver and <br />perform all such further agreements, instruments, documents and acts in the name of and <br />on behalf of the City as shall be required to carry out the intent and purposes of this <br />Ordinance. <br />SECTION 3: That this Ordinance supersedes all other Ordinances and/or <br />Resolutions previously adopted by this Council relative to the Collective Bargaining <br />Agreement between the City and AFSCME Ohio Council 8 and Local 3517.
