Ordinance No. 2005 -22 <br />the Commission shall be a member of the Commission and shall be chosen by the members of <br />that Commission. The Commission shall meet within thirty days after the effective date of this <br />section to hold an organizational meeting to name its Chairman and further shall hold an <br />organizational meeting in January of each year thereafter. <br />(b) (1) The Ethics Commission established in subsection (a) hereof shall be <br />charged with the duty of investigating any charge of conflict of interest <br />and/or unethical conduct brought against any appointed or elected <br />official, member of any duly constituted committee or commission, or <br />employee of the City, pursuant to this chapter, or any other ordinance <br />adopted by the City. The Commission shall meet within seventy -two <br />hours of a charge of conflict of interest and/or unethical conduct having <br />been made in writing and placed before the Chairman of the <br />Commission. <br />(2) The Commission shall then meet only if a charge of conflict of interest <br />and/or unethical conduct has been made and placed before them. All <br />meetings, except the organizational meeting, shall be private and closed <br />to the public. If, after meeting on a question of conflict of interest and/or <br />unethical conduct on the part of an appointed or elected official, <br />committee or commission member, or employee of the City, a majority <br />finds probable cause that there is a conflict of interest and/or unethical <br />conduct on the part of an employee, the matter shall be submitted to the <br />Director of Law for advice and opinion. If, after giving his opinion, any <br />two members disagree with the Director of Law's opinion, the same shall <br />be so stated and the matter shall be submitted to the Ohio Ethics <br />Commission for a further opinion. Such opinion from the Ohio Ethics <br />Commission shall then be final and conclusive and the provisions of <br />Section 107.13 shall then be invoked if a conflict of interest and/or <br />unethical conduct is found to exist. <br />(c) Any elected or appointed official, member of any duly constituted committee or <br />commission, or employee of the City, or member of the Ethics Commission, either bringing a <br />charge or investigating a charge of conflict of interest and/or unethical conduct shall not reveal <br />any such charge until the Ethics Commission has investigated the matter and issued an opinion <br />on same. Failure to do so, on the part of any of the aforesaid individuals shall constitute a <br />violation of Sections 107.01 and 107.02, and shall be considered to be grounds for disciplinary <br />action under Section 107.13. <br />(d) In the event that any member of the Ethics Commission, or the Director of Law, <br />shall be charged with a conflict of interest and/or unethical conduct, that charge shall be <br />automatically referred to the Ohio Ethics Commission for an opinion. If the Commission finds a <br />conflict of interest and/or unethical conduct to exist, the provisions of Section 107.13 shall then <br />be invoked for appropriate disciplinary action." <br />SECTION 2: That all ordinances, or parts of ordinances, inconsistent or in conflict with <br />this Ordinance, are, to the extent of such inconsistency or conflict, repealed. <br />
