(b) The parties agree that all other capital improvements to <br />which the Authority is to retain pursuant to the terms of the <br />1999 Operating Agreement shall be removed by the Authority <br />from City property not later than June 30, 2005. The <br />Authority shall be responsible for all removal costs as set <br />forth in the 1999 Operating Agreement. The City agrees that <br />it will cooperate with the Authority in the removal of such <br />capital improvements. The Authority shall restore the City's <br />property to the condition as it existed immediately prior to the <br />installation of any such capital improvements. <br />3. Service Guarantees by the Authority. <br />(a) The Authority agrees and warrants that during the period <br />commencing upon the closing date of this Agreement and <br />ending March 31, 2008, the Authority shall provide transit <br />service within the City and the area served by the City's transit <br />system, at a level not less than the level of service provided <br />within such service area as of December 2004's revenue route <br />miles and revenue service hours and as annually adjusted for <br />school service. <br />(b) The Authority further agrees that it will use its best efforts to <br />enhance the quality of public transit service rendered to the <br />City. The Authority shall have the right to discontinue or adjust <br />the frequency of any existing or additional route or service, if <br />such route or service is not meeting the performance <br />requirements of the Authority's service policies for effective <br />public transit service.
