The Property Maintenance Officers <br />may extend the time for correction or abatement of the violation for an <br />additional a period of time not to exceed thirty days except where major <br />capital improvements or renovations are involved, in which instance the <br />time for completion may be extended for a period not to exceed ninety <br />days beyond the expiration date of the original violation notice. or-the <br />final deeision of the Board of Building Appeals. <br />(64) Noncompliance with notice. Whenever the owner, agent, <br />occupant or operator of a structure or premises fails, neglects or refuses to <br />comply with any notice of the Property Maintenance Officer that b°eeffi°s <br />anal e fde,.., pr-evided in paragraph (o) «) he fee f the Property <br />Maintenance Officer may advise the Director of Law or the Prosecutor of <br />the circumstances and request the Director of Law or the Prosecutor to <br />institute an appropriate action at law to compel compliance. <br />(75) Referral of violations. Any violation of any ordinance other <br />than this Code discovered by the Property Maintenance Officer or his <br />representative shall be reported to the official or agency responsible for <br />the enforcement of such ordinance. <br />(86) Where notice and hearing not required Prior to Court <br />proceedings. Notwithstanding the requirements of paragraphs (e)(1) <br />through (e)(-4-2) hereof, violations of the following section may be <br />prosecuted without notice by the filing of a complaint by the Property <br />Maintenance Officer in the Rocky River Municipal Court: 1363.08(d). <br />(17) Effect of notice on owners. For the purposes of <br />enforcement of this Code, the service of a notice on an owner, whether or <br />not the owner is also the operator, shall constitute notice of violations set <br />forth therein until such violations are abated in conformity with this Code <br />and other applicable ordinances of the City." <br />SECTION 2: That Section 1363.10 of Chapter 1363 of the Real Property Maintenance <br />Code, entitled "Powers and Duties of Property Maintenance Officer," which presently reads as <br />follows: <br />"1363.10 POWERS AND DUTIES OF PROPERTY MAINTENANCE OFFICER. <br />(a) Adoption of Rules and Regulations. The Property Maintenance Officer is hereby <br />authorized to promulgate such written rules and regulations as may be necessary for the proper <br />interpretation and administration of the provisions of this chapter, provided that such rules and <br />regulations do not conflict with this chapter and conform to the general standards prescribed by <br />this chapter. The Property Maintenance Officer shall file copies of such rules and regulations <br />with the Clerk of Council, the City Engineer, the Fire Chief, the Planning, Zoning, Building <br />Codes and Legislation Committee of Council, and the Board of Building Code Appeals, and <br />shall make available in the Property Maintenance Officer's office a copy for inspection by <br />members of the public during regular business hours. <br />(b) Power to Vary or Modify Provisions of Code. <br />(1) Conditions.
