<br />Resolution No. 2005 -10
<br />WHEREAS, the 2001 pilot testing demonstrated that the City of North Royalton,
<br />Ohio Sludge Composting Facility has sufficient stabilization capacity for processing
<br />biosolids generated by the City of North Royalton, Ohio wastewater treatment facilities
<br />and the City of North Olmsted, Ohio wastewater treatment facilities; and
<br />WHEREAS, during the period December 5, 2001, through December 31, 2004,
<br />the Cities of North Olmsted and North Royalton entered into a series of four (4) interim
<br />agreements, pending Ohio EPA authorization of a more permanent arrangement,
<br />providing for the stabilizing and disposal of biosolids from the North Olmsted
<br />Wastewater Treatment Plant to the North Royalton Sludge Composting Facility; and
<br />WHEREAS, Ohio EPA has, effective October 7, 2004, provided the last approval
<br />necessary to enable the parties to enter into a more permanent agreement if they so
<br />choose; and
<br />WHEREAS, it is the recommendation of the Administrations of the Cities of
<br />North Olmsted and North Royalton to, at this time, enter into only a one -year agreement
<br />for the period January 1, 2005, through December 31, 2005, providing for the
<br />stabilization and disposal of biosolids from the North Olmsted Wastewater Treatment
<br />Plant to the North Royalton Sludge Composting Facility, and which would also permit
<br />the City of North Olmsted to dispose of its Wastewater Treatment Plant's biosolids at
<br />other facilities if, in its sole discretion, North Olmsted believes that it can do so more cost
<br />effectively at such other facilities;
<br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
<br />OF N ORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO:
<br />SECTION 1. That the Mayor, upon approval by the Board of Control, be and he
<br />is hereby authorized, on behalf of the City of North Olmsted, to enter into an agreement
<br />with the City of North Royalton, Ohio, providing for the stabilization of biosolids
<br />generated by the North Olmsted Wastewater Treatment Plant at the City of North
<br />Royalton, Ohio Sludge Composting Facility, and also the disposal of the stabilized
<br />biosolids performed by the City of North Royalton, Ohio, for a one -year term from
<br />January 1, 2005, through December 31, 2005, in an amount not to exceed $150,000.00
<br />The agreement, which shall also provide that the City of North Olmsted may dispose of
<br />some or all of the biosolids from its Wastewater Treatment Plant at other approved
<br />facilities in 2005 if it believes it can do so more cost effectively, shall be substantially in
<br />the form and substance of the agreement attached to this Resolution as Exhibit A, with
<br />only such changes to be hereinafter made as are not substantially adverse to the City of
<br />North Olmsted and which are approved by the Director of Law. The character of any
<br />such changes as not being substantially adverse to the City shall be evidenced
<br />conclusively by the execution of the Agreement by the Mayor and the approval of the
<br />Agreement by the Director of Law.
