CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2007 - 157 <br />BY: Mayor O'Grady <br />A RESOLUTION EXTENDING AND AMENDING THE CITY'S <br />CONSULTING ENGINEERING CONTRACT WITH RICHARD L. <br />BOWEN & ASSOCIATES, INC., WHICH, INTER ALIA, PROVIDES FOR <br />THE RENE WAL OF THE APPOINTMENT OF DANIEL J. COLLINS TO <br />BE CITY ENGINEER AND FOR THE APPOINTMENT OF n"'?T <br />641 I? PIETRO A. DIFRANCO TO BE ASSISTANT CITY ENGINEER, <br />AND DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, pursuant to the authorization of Ordinance No. 2006-118, the Director of <br />Public Service conducted an RFP process which resulted in the selection of Richard L. Bowen <br />& Associates, Inc. [hereinafter referred to as "Bowen and Associates"] to provide consulting <br />engineering services to the City as needed by the City, and for the appointment of Daniel J. <br />Collins to serve as City Engineer; and <br />WHEREAS, this Council has twice extended the consulting engineering services <br />contract of Bowen and Associates, first pursuant to Resolution 2007-62 (adopted on June 19, <br />2007) and then pursuant to Resolution 2007-120 (adopted on October 16, 2007), which latter <br />legislation provided for the said contract to extend to January 29, 2008; and <br />WHEREAS, it is now the desire of the City Administration, as part of its proposed <br />reorganization of the Engineering and Building Divisions of the City government, to extend <br />and amend the City's contract with Richard L. Bowen & Associates for atwe ye one-year <br />term, to extend the appointment of Daniel J. Collins as City Engineer, and to provide for the <br />appointment of Bri^H rG^v° pietro A. DiFranco as Assistant City Engineer; and <br />WHEREAS, the Administration has requested that it be authorized to dispense with <br />the City's RFP process as set forth in NOCO Sections 111.03 et seq., because it is satisfied <br />with the consulting engineering services provided to the City to date by Richard L. Bowen &. <br />Associates, Inc., and even more importantly because changing consulting engineering firms in <br />the middle of the ongoing reorganization of the Engineering Division of the City would <br />hamper the Administration, interfere with that reorganization effort, and possibly cause <br />interruptions in the delivery of needed engineering services; and <br />WHEREAS, it is accordingly the desire of this Council, acting upon the <br />recommendation of the Mayor and the Director of Public Service, to authorize the Mayor to <br />enter into a new contract with Richard L. Bowen & Associates, Inc., extending and amending <br />the current contract in order to provide for the latter to continue to provide consulting <br />engineering services to the City, and further provide far the renewed appointment of Daniel J. <br />Collins to serve as City Engineer, and for the appointment ofBri^^ TC^"° pietro A. <br />DiFranco to serve as Assistant City Engineer; <br />
