CITY OF NORTH OLMSTED RESOLUTION NO. 2007 - 157 BY: Mayor O'Grady A RESOLUTION EXTENDING AND AMENDING THE CITY'S CONSULTING ENGINEERING CONTRACT WITH RICHARD L. BOWEN & ASSOCIATES, INC., WHICH, INTER ALIA, PROVIDES FOR THE RENE WAL OF THE APPOINTMENT OF DANIEL J. COLLINS TO BE CITY ENGINEER AND FOR THE APPOINTMENT OF n"'?T 641 I? PIETRO A. DIFRANCO TO BE ASSISTANT CITY ENGINEER, AND DECLARING AN EMERGENCY, AS AMENDED. WHEREAS, pursuant to the authorization of Ordinance No. 2006-118, the Director of Public Service conducted an RFP process which resulted in the selection of Richard L. Bowen & Associates, Inc. [hereinafter referred to as "Bowen and Associates"] to provide consulting engineering services to the City as needed by the City, and for the appointment of Daniel J. Collins to serve as City Engineer; and WHEREAS, this Council has twice extended the consulting engineering services contract of Bowen and Associates, first pursuant to Resolution 2007-62 (adopted on June 19, 2007) and then pursuant to Resolution 2007-120 (adopted on October 16, 2007), which latter legislation provided for the said contract to extend to January 29, 2008; and WHEREAS, it is now the desire of the City Administration, as part of its proposed reorganization of the Engineering and Building Divisions of the City government, to extend and amend the City's contract with Richard L. Bowen & Associates for atwe ye one-year term, to extend the appointment of Daniel J. Collins as City Engineer, and to provide for the appointment of Bri^H rG^v° pietro A. DiFranco as Assistant City Engineer; and WHEREAS, the Administration has requested that it be authorized to dispense with the City's RFP process as set forth in NOCO Sections 111.03 et seq., because it is satisfied with the consulting engineering services provided to the City to date by Richard L. Bowen &. Associates, Inc., and even more importantly because changing consulting engineering firms in the middle of the ongoing reorganization of the Engineering Division of the City would hamper the Administration, interfere with that reorganization effort, and possibly cause interruptions in the delivery of needed engineering services; and WHEREAS, it is accordingly the desire of this Council, acting upon the recommendation of the Mayor and the Director of Public Service, to authorize the Mayor to enter into a new contract with Richard L. Bowen & Associates, Inc., extending and amending the current contract in order to provide for the latter to continue to provide consulting engineering services to the City, and further provide far the renewed appointment of Daniel J. Collins to serve as City Engineer, and for the appointment ofBri^^ TC^"° pietro A. DiFranco to serve as Assistant City Engineer;
