<br />(b) In the event that the street opening is commenced prior to the payTnent of the <br />permit fee and deposit referred to in subsection (a) hereof, then the applicant shall pay a permit <br />fee to the City in the amount of one hundred fifty dollars ($150.00) to the General Fund in <br />addition to the deposit otherwise required in subsection (c) hereof. The City Engineer may issue <br />a stop work order until such time as the permit fee and deposit money have been received by the <br />City. <br />(c) The minimum deposit for pavement borings or openings referred to in subsection <br />(a) hereof shall be as follows: <br />(1) Brookpark Road, Columbia Road (S.R. 252 <br /> south of Buttemut Ridge Road), Great Northem <br /> Boulevard and Lorain Road: $3,000 <br />(2) Al Moen Drive, Brookpark Road Extension, <br /> Country Club Boulevard, Dover Center Road, <br /> Industrial Parkway and Sparky Lane: $2,500 <br />(3) Barton Road, Bradley Road, Buttemut Ridge <br /> Road, Canterbury Road, Cedar Point Road, <br /> Clague Road, Columbia Road (except S.R. 252 <br /> south of Buttemut Ridge Road), Fitch Road, <br /> Gessner Road, Kennedy Ridge Road (between <br /> Victoria Lane and Buttemut Ridge Road), <br /> McKenzie Road, Mastick Road, Mill Road, <br /> Porter Road, Steams Road, Victoria Lane and <br /> Walter Road: $2,000 <br />(4) All other streets with concrete pavement and <br /> curbing: $1,500 <br />(5) All other streets not included in items (1) <br /> through (4): $750.00 <br />(d) A public utility company is not required to pay a fee or deposit in order to obtain <br />a permit for a street opening provided that the public utility company post a bond in an amount <br />not less than ten thousand dollars ($10,000) obligating the public utility company, successors or <br />assigns to faithfully comply with all ordinances, rules and regulations pertaining to street <br />openings and shall save and keep harmless the City from all loss or damage which it may sustain <br />or for which it may become liable on account of the issuance of said street opening permit. Also, <br />with the application for a street opening permit, the public utility company must agree to pay for <br />inspection charges by the Engineering Department when invoiced by the City unless a deposit is <br />made in accordance with subsection (c) hereof The rate of inspection shall be as specified in <br />Section 901.05. <br />(Ord. 96-26. Passed 3-5-96.) <br />901.02 ISSUANCE REQUIREMENTS. <br />No such permit shall be issued until: <br />(a) The applicant shall have made the deposit referred to in Section 901.01 or 901.07 <br />or the public utility has complied with the requirements of Section 90 1.01 (d). <br />Such pennit shall state the exact time the opening or excavation is to be made, the <br />probable length of time for doing the work and the making of the repair, the <br />character of the pavement, including its base, and the character of the work <br />necessary for the satisfactory repairing or relaying of the roadway. <br />(b) The applicant including a public utility company, shall have submitted a policy or <br />policies of liability or indemnity insurance issued by companies licensed to do <br />business in the State, recognizing the City as an insured, in a total amount of not <br />less than five hundred thousand dollars/one million dollars ($500,0001$1,000,000) <br />for any personal injury or injuries incurred and two hundred thousand dollars <br />($200,000) for any property damage caused as a result or consequence of the <br />2 <br />
