<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2007 - 146 <br />By: Mayor O'Grady <br />A RESOL UTION A UTHORIZING THE DIRECTOR OF HUMAN <br />RESOURCES, ON BEHALF OF THE CITY OF NORTH OLMSTED, TO <br />APPL Y TO THE B UREA U OF WORKERS COMPENSA TION FOR <br />ALLOWANCE TO BEGINA SELF-INSURED WORKERS COMPENSATION <br />PROGRAM FOR NORTH OLMSTED EMPLOYEES; FURTHER <br />A UTHORIZING THE MA YOR TO EXECUTE ANY CONTRACTS OR <br />RELATED PAPERS REQUIRED TO EFFECTUATE SUCH A SELF- <br />INSURED PROGRAM; AND DECLARING AN EMERGENCY. <br />WHEREAS, Sections 4123.35 and 4123.353 of the Ohio Revised Code, and Section <br />4123-19-03 of the Ohio Administrative Code, provide for public employers to become self- <br />insured for purposes of complying with the workers compensation laws of the State of Ohio, <br />upon demonstrating sufficient financial ability to make payments of compensation, medical <br />expenses, funeral expenses, and other such payments directly to injured public employees and <br />dependents of killed public employees; and <br />WHEREAS, the Director Human Resources and the Director of Finance have reviewed <br />the requirements for initiating a self-insured program for City of North Olmsted employees, and <br />recommend to this Council that the City is financial qualified to operate such a self-insured <br />program, and that the operation of a self-insured program would be both in the best interests of <br />City employees and would further save tax dollars; and <br />WHEREAS, it is the desire of this Council, acting upon the recommendations of the <br />Directors of Human Resources and Finance, to authorize the Director of Human Resources, to <br />the extent that such authorization is required by law, to apply to the Bureau of Workers <br />Compensation for allowance to begin a self-insured workers compensation program for North <br />Olmsted city employees, and further autharizing the Mayor, to the extent that such authorization <br />is required by law, to execute any contracts or related papers required to effectuate such a self- <br />insured workers compensation program for North Olmsted city employees; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Human Resources be and she is hereby authorized to <br />apply to the Bureau of Workers Compensation for allowance to begin a self-insured workers <br />compensation program for North Olmsted city employees, and the Mayor is authorized to <br />execute any contracts or related papers required to effectuate such a self-insured workers <br />compensation program for North Olmsted city employees. <br />SECTION 2: That, pursuant to the provisions of Section 5701.12 of the Ohio Revised <br />Code, there is hereby created a special fund, entitled the Self-Insured Workers Compensation <br />fiind, for the purposes of beginning and operating a self-insured workers compensation program <br />far North Olmsted city employees. <br />
