., CITY OF NORTH OLMSTED RESOLUTION NO. 2007 - 144 By: Mayor O'Grady and A RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE TO APPL Y FOR, AND THE MA YOR TO A CCEPT AND ENTER INTO A WA TER POLLUTION CONTROL LOAN FUND AGREEMENT OR AGREEMENTS ON BEHALF OF THE CITY OF NORTH OLMSTED, OHIO, FOR THE PLANNING, DESICN AND/OR CONSTRUCTION OF WASTE WATER FACILITIES; AND DESIGNATING A DEDICATED REPAYMENT SOURCE FOR THE LOAN OR LOANS. WHEREAS, the City of North Olmsted, Ohio seeks to upgrade its existing wastewater facilities; WHEREAS, the City of North Olmsted, Ohio intends to apply for a loan(s) from the Water Pollution Control Loan Fund (WPCLF) for the planning, design and/or construction of wastewater facilities; and WHEREAS, the Ohio Water Pollution Control Loan Fund requires the government authority to pass legislation far application of a loan(s) and the execution of an agreement or agreements, as we11 as designating a dedicated repayment source. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Director of Public Service be and is hereby authorized to apply for a WPCLF loan or loans, and the Mayor be and is hereby authorized to sign all documents far and enter mto a Water Pollution Control Loan Fund agreement or agreements with the Ohio Environmental Protection Agency and the Ohio Water Development Authority for the planning, design and/or construction of wastewater facilities on behalf of the City of North Olmsted, Ohio. SECTION 2: That the dedicated source of repayment far said loan or loans will be the users fees from the Sewer Revenue Fund. SECTION 3: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further for the reason that it is necessary that this Resolution go into effect immediately because of a December 2007 loan application deadline for the initial planning services component of the loan, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
