<br />., <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2007 - 144 <br />By: Mayor O'Grady <br />and <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE TO <br />APPL Y FOR, AND THE MA YOR TO A CCEPT AND ENTER INTO A WA TER <br />POLLUTION CONTROL LOAN FUND AGREEMENT OR AGREEMENTS ON <br />BEHALF OF THE CITY OF NORTH OLMSTED, OHIO, FOR THE PLANNING, <br />DESICN AND/OR CONSTRUCTION OF WASTE WATER FACILITIES; AND <br />DESIGNATING A DEDICATED REPAYMENT SOURCE FOR THE LOAN OR <br />LOANS. <br />WHEREAS, the City of North Olmsted, Ohio seeks to upgrade its existing wastewater facilities; <br />WHEREAS, the City of North Olmsted, Ohio intends to apply for a loan(s) from the Water <br />Pollution Control Loan Fund (WPCLF) for the planning, design and/or construction of wastewater <br />facilities; and <br />WHEREAS, the Ohio Water Pollution Control Loan Fund requires the government authority to <br />pass legislation far application of a loan(s) and the execution of an agreement or agreements, as we11 as <br />designating a dedicated repayment source. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and is hereby authorized to apply for a <br />WPCLF loan or loans, and the Mayor be and is hereby authorized to sign all documents far and enter mto <br />a Water Pollution Control Loan Fund agreement or agreements with the Ohio Environmental Protection <br />Agency and the Ohio Water Development Authority for the planning, design and/or construction of <br />wastewater facilities on behalf of the City of North Olmsted, Ohio. <br />SECTION 2: That the dedicated source of repayment far said loan or loans will be the users <br />fees from the Sewer Revenue Fund. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately because of a <br />December 2007 loan application deadline for the initial planning services component of the loan, <br />and further provided it receives the affirmative vote of two-thirds of all members of Council, it <br />shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />
