<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 - 143 <br />BY: Mayor O'Grady <br />AN ORDINANCE AMENDING SECTIONS 351.18 AND 351.20 OF <br />THE TRAFFIC CODE IN ORDER TO INCREASE THE PENALTIES <br />FOR HANDICAPPED PARKING VIOLATIONS SO AS TO MIRROR <br />CURRENT STA TE LA W, AS AMENDED. <br />WHEREAS, Section 351.20 of the Traffic Code prohibits non-disabled persons <br />from parking their motor vehicles in parking spaces designated for disabled persons; and <br />WHEREAS, all violations of said Section 351.20 are currently classified as minor <br />misdemeanors under the City's Traffic Code; and <br />WHEREAS, it is the recommendation of the Mayor and the desire of this Council <br />to amend Sections 351.18 and 351.20 of the Traffic Code to provide for penalties for <br />violations of paragraph (b) of Section 351.20, subtect to the provisions of Section 351.18 <br />that provide for initial disposition of parking tickets at the North Olmsted police <br />department, to be the same as those provided for under Section 4511.69 of the Ohio <br />Revised Code; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION L• That Sections 35 L 18 and 351.20 of the Traffic Code, which <br />presently reads as follows: <br />351.18 PARKING TICKET PROCEDURES. <br />(a) Parking tickets shall be written on a pre-printed form approved by the <br />Chief of Police, which shall include all information necessary to identify the motor <br />vehicle in violation and its registered owner. Upon observation of a parking violation, <br />parking tickets may be issued by any police officer or auxiliary police officer <br />specifically designated by the Chief of Police, and shall then be securely placed upon <br />the vehicle parked in violation of this chapter, specifically by placing a copy of the <br />parking ticket beneath the windshield wiper on the driver's side of the vehicle. The <br />registered owner of a motor vehicle ticketed for a parking violation shall appear at the <br />North Olmsted Police Department to pay the fine for such parking violation, in person, <br />through a designated representative, or postmarked by mail, within forty-eight hours <br />after the issuance of such parking ticket, Sundays or holidays excepted, and pay a fine <br />of fifteen dollars ($15.00), without costs. If such payment is tendered or postmarked <br />more than forty-eight hours after such issuance, Sundays or holidays excepted, then the <br />fine shall be increased to twenty-five dollars ($25.00), without costs. Voluntary <br />payment of such fine shall not be deemed a formal admission of guilt but shall <br />constitute acknowledgment of the validity of the parking ticket and shall preclude the <br />prosecution of the misdemeanor offense alleged therein. <br />(b) Notwithstanding other fees contained herein, any violator of Section <br />351.20(b)(1) shall pay a fine of fifty dollars ($50.00) without costs. <br />
