<br />Ordinance No. 2007-143 <br />351.18 PARKING TICKET PROCEDURES. <br />(a) Parking tickets shall be written on a pre-printed form approved by the <br />Chief of Police, which shall include all information necessary to identify the motor <br />vehicle in violation and its registered owner. Upon observation of a parking violation, <br />parking tickets may be issued by any police officer or auxiliary police officer <br />specifically designated by the Chief of Police, and shall then be securely placed upon <br />the vehicle parked in violation of this chapter, specifically by placing a copy of the <br />parking ticket beneath the windshield wiper on the driver's side of the vehicle. The <br />registered owner of a motor vehicle ticketed for a parking violation shall appear at the <br />North Olmsted Police Department to pay the fine for such parking violation, in person, <br />through a designated representative, or postmarked by mail, within forty-eight hours <br />after the issuance of such parking ticket, Sundays or holidays excepted, and pay afine <br />of fifteen dollars ($15.00), without costs. If such payment is tendered or postmarked <br />more than forty-eight hours after such issuance, Sundays or holidays excepted, then the <br />fine shall be increased to twenty-five dollars ($25.00), without costs. Voluntary <br />payment of such fine shall not be deemed a formal admission of guilt but shall <br />constitute acknowledgment of the validity of the parking ticket and shall preclude the <br />prosecution of the misdemeanor offense alleged therein. <br />(b) Notwithstanding other fees contained herein, any violator of Section <br />351.20(b)(1) shall pay a fine of fifty dollars ($50.00) without costs. <br />(c) Unless a different penalty is expressly provided for in another <br />section of this Chapter, Wwhoever violates any provision of this chapter shall be <br />guilty of a misdemeanor. If a parking ticket is not paid within a seventy-two hour <br />period pursuant to the procedure provided in paragraph (a), then the Police Department <br />shall issue at least one (1) written communication to the registered owner of the motor <br />vehicle that was issued the parking ticket, at the address of registration on record with <br />the Bureau of Motor Vehicles, and therein advise the registered owner of the unpaid <br />parking ticket. Such written communication shall be forwarded by regular mail and <br />shall further advise that any unpaid parking ticket will be forwarded to the Rocky River <br />Municipal Court, by a date specific, not less than ten (10) days from the date of such <br />correspondence, for further proceedings and prosecution of the parking violation, <br />subject to the imposition of Court costs. Unpaid parking violations may then proceed <br />to Rocky River Municipal Court upon the issuance of a uniform traffic citation and <br />subject to all procedures therein. Such parking violations thereafter shall be subject to <br />the penalties provided in this Chapter, or if no specific penalty is provided for a <br />section of in this Chanter, then in accordance with Section 303.99.-?afid all <br />351.20 HANDICAPPED PARKING. <br />(a) Special parking locations and privileges for persons with disabilities that <br />limit or impair the ability to walk, also known as handicapped parking spaces or <br />disability parking spaces, shall be provided and designated by all political subdivisions <br />and by the State and all agencies and instrumentalities thereof at all offices and <br />facilities, where parking is provided, whether owned, rented, or leased, and at all <br />publicly owned parking garages. The locations shall be designated through the posting <br />of an elevated sign, whether permanently affixed or movable, imprinted with the <br />international symbol of access and shall be reasonably close to exits, entrances, <br />elevators, and ramps. All elevated signs posted in accordance with this paragraph and <br />paragraph (C) of Section 3781.111 of the Ohio Revised Code shall be mounted on a <br />fixed or movable post, and the distance from the ground to the top edge of the sign <br />shall measure five feet.
