<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2007 - 130 <br />BY: Mayor O'Grady <br />A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF <br />NORTH OLMSTED TO ENTER INTO AN AGREEMENT WITH THE <br />CITY OF BEDFORD HEIGHTS, PROVIDING FOR THE SAID CITY <br />TO HOUSE NORTH OLMSTED PRISONERS AT THE BEDFORD <br />HEIGHTS CITY JAIL, AND DECLARING AN EMERGENCY. <br />WHEREAS, due to overcrowding, Cuyahoga County does not accept misdemeanant <br />prisoners from North Olmsted awaiting hearing or trial, or convicted and sentenced under the <br />State Traffic or Criminal Code; and <br />WHEREAS, the City of North Olmsted municipal jail is a five-day holding facility <br />only, and may not house prisoners sentenced for misdemeanor convictions for periods that <br />oxceed five days; and <br />WHEREAS, it is necessary from time to time that the North Olmsted police <br />department arrange and make provision for the transport to and housing of prisoners at other <br />jails; and <br />WHEREAS, the City of Bedford Heights has a State approved facility for housing <br />prisoners for more than five (5) day periods of confinement and is willing to house North <br />Olmsted misdemeanant prisoners, who are either awaiting hearing or trial, or have been <br />convicted and sentenced to more than five (5) days imprisonment under the State Traffic or <br />Criminal Code, at the Bedford Heights City Jail, at a per diem charge which is equal to the <br />amount which the City presently receives by way of reimbursement by Cuyahoga County for <br />the housing of misdemeanant prisoners sentenced under the State Code; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to enter into an agreement with the <br />City of Bedford Heights, providing for the housing of City of North Olmsted's misdemeanant <br />piā¢isoners awaiting hearing or trial, and/or convicted and sentenced under the State Traffic or <br />Criminal Code. The agreement shall be substantially in the form of the three-page "Bedford <br />Heights Ciry Jail Contractiug F,ntiry Contractual Agreement" attached to this Resolution and <br />marked as "Exhibit A," with only such changes therein as are not substantially adverse to the <br />City and which are approved by the Mayor and the Director of Law.
