7. Bedford Heights agrees that where hospital services are required for any such <br />prisoner(s), such services shall be provided at Meridia South Pointe Hospital, unless <br />the emergency of the situation or circumstance prevents such use; in addition the <br />Contracting Entity agrees to supply security for the Contracting Entity prisoner(s) if <br />hospitalized. The medical staff of the Bedford Heights City Jail shall determine the <br />need for such services. <br />Bedford Heights may reject ar refuse to receive any prisoner who may be inflicted <br />with a prior medical problem such as a contagious disease, mental condition, illness <br />or injury that has not been first treated prior to entry into the Bedford Heights City <br />Jail. The Bedford Heights Chief of Police shall have charge of the jail and he, or his <br />designee, may, in the exercise of his or her discretion, refuse to receive any prisoner <br />for any reason based upon current jail population, internal security conditions of the <br />jail, or any other reasons including availability of space. <br />9. This Agreement is based upon daily availability of space in the Bedford Heights <br />jail. The parties recognize that Bedford Hei.ghts has commitments with other <br />Participating and Cooperating Communities that will affect availability of space and <br />may be reason to remove prisoner(s) of the Contracting Entity from the Bedford <br />Heights jail and return the custody, supervision, confinement and board of them to <br />the Contracting Entity. Specifically , the Joint Agreement referred to above with the <br />Participating Communities of the Village of Moreland Hills, the Village of <br />Glenwillow and the Village of Chagrin Falls pursuant to which the City of North <br />Olmsted, will be considered as a Contracting Entity states as follows: <br />"3.03 The City of Bedford Heights may permit Cooperating Communities to <br />use the Facility on an as-available daily basis. In the event the Facility is full <br />at the time a Participating Community has need for the use of the Facility <br />for the number beds specified in Section 3.02*, the City of Bedford Heights <br />shall make a good faith attempt to relocate prisoners of a Cooperating <br />Community or else advise the Cooperating Community to remove their <br />prisoner in order to provide room for the prisoner of a Participating <br />Community. Bedford Heights shall also give preference to other <br />Participating Communities over Cooperating Communities in filling <br />guaranteed beds that are temporarily not being used by a Participating <br />Community." <br />Male Female <br />Chagrin Falls 4 2 <br />Village of Glenwillow 3 2 <br />Village of Moreland Hills 2 1 <br />City of Bedford Heights 15 5 <br />2 <br />
