4. That the COUNTY will review the construction plans for conformance with section B-2 of this Agreement. County approval of plans and specifications is required prior to the award of the construction contract. The COIINTY will make an inspection of the completed project. 5. That the MUNICIPALLITY shall agree to provide the COiJNTY with a complete set of as-built plans upon the completion of the project. C. FUNDING 1. That the MUNICIPALITY hereby agrees to participate with the COUNTY in the cost of the improvement by an allocation from the County Motor Vehicle License Taac Fund to pay the COUNTY portion of the project. 2. That if the project is financed with State or Federal-aid funds, eligible costs of the improvement shall be financed from the aforesaid funds. 3. T'hat if funds administered by the Oluo Public Works Commission are used for this project, the amount of such funds will be deducted from designated project costs prior to the application of the participatory percentages specified in this Agreement. 4. That the COUNTY sha11 contribute ten percent (10%) of the non-Issue 1 share of the cost of construction which is determined to be eligible by the Cuyahoga County Engineer's policies up to a maximum of $ 260,000.00. The anticipated construction cost for this project is $ 2,600,000.00. To determine funding eligibility, the COLJNTY shall be norified immediately of any significant changes to the scope of work and/or construction cost. Within the corporate limits of the MUNICIPALITY, the MtJNICIPALITY shall contribute ten percent (10%) of the non-Issue 1 share of the cost of construction determined to be eligible by the Cuyahoga County Engineer's policies and one hundred percent (100%) of the cost of construction supervision, engineering, right-of-way, contract administration, and construction determined not eligible by the Cuyahoga County Engineer's policies. Any terms appearing elsewhere in this Agreement which vary from those set forth in this paragraph shall take precedence. D. MAINTENANCE That upon completion of said improvement, said MUNICIPALIT'Y will thereafter keep said highway open to traffic at all times; and 1. Maintain the improvement in accordance with the provisions of the statutes relating thereto and make ample financial provisions for such maintenance; and 2. Maintain the right-of-way and keep it free of obstructions in a manner satisfactory to the COUNTY and hold said right-of-way inviolate for public highway purposes and permit no signs, posters, billboazds, roadside stands or other private installations within the ri,ght-of- way limits; and -2- ? ???-?., ,-,.. ?t ,. .- -11 ?. ,,,
