AOft <br />issues that need to be addressed. <br />(c) Where it is determined that there is insufficient information, the <br />complainant(s) must be notified immedialely (by the Sth day after receipt <br />of the complaint) and informed, both personally and in writing, what <br />information must be provided to constitute the filing of a complaint. The <br />complainant should be advised that unless the required information is <br />received, no assistance could be provided. <br />(d) If the required infoimation is not received no further action is <br />necessary. <br />The complaint may be filed with the assistance of an authorized <br />representative of the person filing the complaint. <br />The State or local agency is required to refer complaints or provide , <br />information to HLTD regal•ding allegations which the agency receives <br />involving a practice that is not covered by the State or local law, but is <br />covered by the Federal Fair Housing Act. (See Sections VII and VIII of <br />the written agreement between the agency and HUD.) <br />Notwithstanding the information in paragraphs 1 through 5 above, <br />HUD may consider jurisdiction based upon information in <br />TEAPOTS, including intake, other interviews, and documents <br />summarized. For Intake for Complaints filed Organizations, see <br />Attachment A. <br />B. Dual-filed Complaints - only dual-filed complaints are considered for payment <br />under the FHAP. <br />A dual-filed complaint is one that has been docketed by both HLTD and the <br />agency. <br />2. Complaints filed first with a State or local agency, and those received by <br />HLTD and subsequently refen-ed to a certified or interim certified agency, <br />are considered dual-filed with the agency under its own law and with HUD <br />under the Federal Fair Housing Act. <br />3. In order- to preserve the statutory period for filing complaints, a complainant <br />may provide information to be included in a complaint by telephone, to the <br />State or local agency, or to HLTD. The FHAP agency or HLTD may reduce the <br />information to writing which is subsequently signed, affirmed, attested to, or <br />notarized by the complainant, as prescribed by the relevant State or loca] ]aw. <br />4. The agency is required to dual-file a housing discrimination complaint <br />within 5 days of its receipt.
