WASHINGTON, DC 20410-2000 <br />J6?N UFVF?O <br />OPFICE OF FAIR HOUSWG <br />AND EQUAL OPPORTUNITY <br />Instructions ancl Guidance for Allocation of Fair Housing Assistance Program (FHAP) Funds <br />Fol• FY 2007/2008 for FHAP Capacity Building Agencies <br />Introduction <br />These instructions provide information for allocating Fair Housing Assistance Prob am <br />(FHAP) funds for FY 2007/2008) for the FHAP Capacity Building (CB) Agencies. The Plan <br />outlines how the 2007/2008 FHAP funds will be used by the FHAP agencies receiving Capacity <br />Building funding. <br />The funds assigned hereunder are for FY 2007/2008 activities only; however, the <br />instructions apply to fiscal year 2007. At the appropriate time, cooperative aa eements will be <br />updated with funds for FY 2008. If there are any changes to these instructions, an amendment will <br />be issued at that time. <br />For any CB agency transitioning from CB status to Contributions status, the GTR must first <br />determine the number of complaints of vVhich a Contributions agreement may be based. They are <br />required to use TEAPOTS to determine this number. They may use any 12-month period between <br />July l, 2005 and September 30, 2006 to make this deternunation. <br />Cauacitv Buildins! A$!encies <br />Capacity Building (CB) agencies are eligible to receive a flat fixed amount of $120,000 for <br />FY2007. However, if the region deterniines that more funds are required, they may make a request <br />for additional funding under Capacity Building. While these instructions cover fiscal years 2007and <br />2008, the funds are for FY2007 only. When FY2008 funds become available, the cooperative <br />agreement will be amended; these instructions will be amended if necessary. <br />Agencies are eligible to receive CB funds for no more than three years. At the beginning of <br />the Agency's fourth year, the GTR will automatically forward a Contributions Cooperative <br />Agreement for execution. If it is more financially advantageous and the GTR's assessment of the <br />CB's complaint processing is sufficient, a CB agency may opt to be paid on a per case basis in its <br />second year. The GTR will work with the Agency in malcing this determination. <br />Also, while CB agencies are not paid on a per case basis unless as noted above, CB <br />agencies are advised that there are situations where the GTR may not permit the dual filing (or <br />dual filing may be delayed) of a complaint. <br />www.hud.gov espanol.hud.gov
