The District may amend or otherwise modify the terms of this Agreement except for the <br />provisions relating to the delivery and price paid for the Newspaper, Mixed Paper and/or <br />Cardboard and the prohibition of the District making any charge to the Political <br />Subdivision for its services under this Agreement. <br />2. The District shall notify the Political Subdivision of any amendment or modification it <br />makes to this Agreement. The Political Subdivision shall thereupon have thirty (30) days <br />from the date of said notice to withdraw from this Agreement, but thereafter withdrawal <br />shall be waived. <br />B. Either the District or Recycler ma.y terminate the Recycler Contract in the event that either the <br />District or Recycler violates their obligations set forth in the Recycler Contract but in such event <br />the District shall make good faith efforts to provide another recycler to provide the same or <br />similar services within 60 days of the Recycter Contract termination. In the event the District is <br />unable to provide another Recycler, the Political Subdivision may withdraw from this Agreement <br />upon 30 days notice and/or the District may termina.te this Agreement upon 30 days' notice. <br />Article VII: Rieht to Withdraw <br />In the event that a Political Subdivision proposes to alter or privatize its municipal collection of <br />Newspaper, Mixed Paper and/or Cardboard such that it has essentially relinquished control of the <br />marketing of its recyclable paper, then it ma.y withdraw from this Agreement upon thirty (30) days' notice <br />to the District and to the Recycler. This provision does not allow a Political Subdivision to periodically <br />sell some of its recyclable paper on the open market to take advantage of ma.rket fluctuations in price. <br />Notice.
