<br />to the driver whether all or portions of the load are rejected on the basis that it <br />does not meet the specifications as outlined in the Recycler Contract. The driver <br />shall assist in cleaning the load to acceptable levels. Unaccepta.ble material shall <br />be removed by the driver or the Political Subdivision shall be charged for its <br />disposal. The Recycler shatl not have the right to reject a delivery once it has <br />accepted same, except for subsequent discovery of haza.rdous substances <br />specified in section I.B.4. below, and the delivering Political Subdivision shall <br />thereafter have no liability for failure of an accepted load to meet specifications. <br />After acceptance of the paper, the delivery vehicle shall be re-weighed empty and <br />the scale ticket printed with the net weight of the accepted load as well as the <br />weight of any rejected material. The driver shall acknowledge the ticket and be <br />given a copy showing the delivering Political Subdivision the grades of paper <br />accepted and/or rejected and the weights of each. <br />4. The Recycler will not accept any substance or material classified as a"hazardous <br />substance" as defined in Section 101(14) of the Comprehensive Environmenta( Response <br />Compensation and Liability Act of 1990 (CERCLA). The Palitical Subdivision warrants <br />that all materials delivered to the Recycling facility shall be free from any hazardous <br />substance as defined in Section 101(14) of CERCLA. The Political Subdivision further <br />agrees that the Recycler may reject a Political Subdivision's paper at any time, even after <br />gate acceptance, up unti( it ships such materiat from the Recycling Facility if it <br />determines that such paper conta.ined any such hazardous substance and the Political <br />Subdivision in such event, agrees to remove same at its expense. <br />Article II• Statements, Pavments and Charges bv the District <br />A. Pursuant_to the Recycler Contract pavments for the Newspaner Mixed Paper and/or Cardboard <br />delivered to the Recycler shall be made monthlYby the Recycler directlv to the Political <br />Subdivision The Rec cy ler agrees to pav $45 00 uer ton for Newspaper, $40 00 per ton for Mixed <br />Paper and $40 00 per ton for Corrugated Cardboard for the term of the Contract. Anv charixes <br />incuned by a Po(itical Subdivision for the added service of conta.iner rental and hautin-g shatl be <br />deducted from the value of the paper collected The charizes for container rental and haulinz will <br />be made according to the Price Sheet included in the Recycler's Proposal (Exhibit B) for the term <br />of the Contract. <br />B. Pursuant to the Recycler Contract, the Recycler shali send to the Political Subdivision, a <br />statement reflecting the amount of Newspaper, Mixed Paper and/or Cardboard received from <br />such Political Subdivision. The Recycler at the same time shall send the Political Subdivision a <br />check for the total amount reflected on the statement. Both the statement and the payment will be <br />made by the 1 d`h day of each month. <br />C. The District shall make no charges to the Political Subdivision for its services as facititator of the <br />??.. ? .._ ? I .
